DOJ AWARDS CHEROKEE TRIBE
$3M+ IN PUBLIC SAFETY GRANTS
The Department of Justice has awarded more than
$18 million in grants to Oklahoma tribal governments
to enhance public health and safety, according to the
Department of Justice for the Eastern District of Oklahoma.
These grants are part of more than $100 million in
grants to 125 American Indian tribes, Alaska Native
villages, tribal consortia, and tribal designees. Many of
these awards were made through the Department’s
Coordinated Tribal Assistance Solicitation (CTAS), a single application for tribal-specific grant programs. The Department developed CTAS through its Office
of Community Oriented Policing Services, Office of Justice Programs and Office on Violence Against Women, and administered the first round of consolidated grants in September 2010.
CTAS grants are designed to enhance law enforcement practices, expand
victim services, and sustain crime prevention and intervention efforts. Awards
cover nine areas: public safety and community policing, justice systems planning, alcohol and substance abuse, corrections and correctional alternatives,
children’s justice act partnerships, services for victims of crime, violence against
women, juvenile justice, and tribal youth programs.
“Reducing violent gang and gun crimes in Indian Country is crucial to protecting citizens who live in and around tribal communities. The justice community
must also look to help those with mental health and substance abuse issues
to re-enter society as productive citizens. These Federal grant allocations will
help to further those goals,” said U.S. Attorney Shores of the Northern District
of Oklahoma.
U.S. Attorney Kuester of the Eastern District of Oklahoma said, “I am pleased
and excited about DOJ’s awards to the tribal governments in Oklahoma. These
grants will fund programs that will assist victims of crimes, reduce crime against
women, and enhance the resources available for tribal governments to combat violent crime, increase public awareness, and provide prevention programs
for youth. The U.S. Attorney’s Office looks forward to assisting in any way
possible as these programs are implemented.” U.S. Attorney Yancey of the
Western District of Oklahoma said, “I join my fellow United States Attorneys in
welcoming the federal law enforcement assistance to our Oklahoma tribes. I
look forward to working with all tribes in the Western District to reduce crime
and aid victims.”
Funds to the Cherokee Nation are as follows:
• Public Safety and Community Policing: $565,241
• Comprehensive Tribal Justice Systems Strategic Planning: $74,995
• Justice Systems and Alcohol and Substance Abuse: $749,993
• Violence Against Women Tribal Governments Program: $898,100
• Comprehensive Tribal Victim Assistance Program: $449,925
• Tribal Youth Program: $349,646
• Total: $3,087,900
Other tribes around the area will also receive grants.

Q: My friend has considered treatment but is afraid of what others will think.
What can I tell my friend?
A: Many employers, friends, and family members will be compassionate
if they see a person is making a sincere effort to recover from a substance
abuse problem. But you can also reassure your friend that laws protect the
privacy of a person seeking drug treatment—or in fact, any medical treatment. Health care providers may not share information with anyone else without a patient’s permission. Some jobs may require a doctor’s note saying
an employee is being treated for a medical condition, but the nature of the
condition need not be specified. For more information on how private medical
information is protected by law, read the HHS information on Health Information Privacy (HIPAA).

A Wagoner man was arrested after officers
found drugs, paraphernalia, and guns in his
home while executing a search warrant on
September 18.
According to the police report, Wagoner County deputies went to the home of
57-year-old Kenneth R. Gillin, located in the
5500 block of E. 100th N., at approximately
11:30 a.m. They were investigating rumors of
the residence housing an indoor marijuana
cultivation operation.
While searching the home, deputies found
two “large very mature” marijuana plants being kept in a locked room. There was also a
prescription bottle in the room with Gillin’s
name on it.
Further searching revealed that the rumors of an indoor cultivation operation were true -- deputies discovered an elaborate irrigation system to the
plants, and a fertilizer and lighting system that was on a timer.
In the master bedroom, they located 18 loaded and unloaded firearms, as
well as a glass marijuana smoking pipe with residue.
In a minor’s bedroom at the residence, deputies found 3 additional “immature” marijuana plants growing.
Gillin wasn’t home when officers searched his residence, but he arrived
shortly after they completed searching his home for illegal items. He was
immediately placed under arrest and transported to the Wagoner County Detention Center.
Gillin is being charged with cultivation of controlled substance, possession
of a firearm during commission of a felony and unlawful possession of drug
paraphernalia. His bond was set at $7,500, and he is scheduled to appear in
court on October 25, 2017.

TIPS FROM A TROOPER
Today we are discussing “Failure to display required
lighting when required on a vessel.” This is covered under Title 63-4207 Lights and other equipment. You need
to know what area your vessel falls in to make sure you
are doing not only what is legal, but also what is safe for
you, occupants of your vessel, and any other vessel in
the vicinity or your vessel. If your vessel does not display
the proper lighting, this would be the equivalent of driving your vehicle on the
roadway without headlights. If the driver cannot see you, they will more than
like not be able to avoid you.
Navigation Lights
The required navigation lights must be displayed between sunset and sunrise and during periods of restricted visibility.
Power-Driven Vessels When Underway
If less than 65.6 feet long, these vessels must exhibit the lights as shown
below. Remember, power-driven vessels include sailboats operating under engine power.
The required lights are:
•Red and green sidelights visible from a distance of at least two miles
away—or if less than 39.4 feet long, at least one mile away—on a dark, clear
night.
•An all-round white light or both a masthead light and a sternlight. These
lights must be visible from a distance of at least two miles away on a dark,
clear night. The all-round white light (or the masthead light) must be at least
3.3 feet higher than the sidelights.
•The masthead light and sternlight may be combined as an all-round white
light on vessels less than 39.4 feet long.
Unpowered Vessels When Underway
Unpowered vessels are sailboats or vessels that are paddled, poled, or
rowed.
If less than 65.6 feet long, these vessels must exhibit the lights as shown
below.
The required lights are:
•Red and green sidelights visible from at least two miles away—or if less
than 39.4 feet long, at least one mile away.
•A sternlight visible from at least two miles away.
•An alternative to the sidelights and sternlight is a combination red, green,
and white light, which must be exhibited near the top of the mast.
If less than 23.0 feet long, these vessels should:
•If practical, exhibit the same lights as required for unpowered vessels less
than 65.6 feet in length.
•If not practical, have on hand at least one lantern or flashlight shining a
white light as below.
•Vessel operators should never leave shore without a flashlight. Even if you
plan to return before dark, unforeseen developments might delay your return
past nightfall.
All Vessels When Not Underway
All vessels are required to display a white light visible in all directions whenever they are moored or anchored outside a designated mooring area between sunset and sunrise.

NO OFFICERS HURT
IN SHOOTOUT
A Stilwell man has been taken into
custody after a shootout with police.
TJ Cain, 46, was charged September
29 with assault and battery with a dangerous weapon, in Adair County District
Court.
According to OSBI, just after 5 a.m.
that morning, a suspect, later identified as Cain, was involved in a drive-by
shooting in Stilwell. Officers spotted the
vehicle described to be involved and attempted to pulled over the vehicle. Cain
refused, leading officers on a pursuit.
The vehicle crashed in the area of 814 E.
Road and 4680 N. Road in Stilwell. Cain
reportedly got out of the vehicle and began running from police. Officers gave
chase. During that chase, Cain fired a weapon at officers. At least one officer
returned fire. This happened several times. At that time, the officer believed he
hit Cain, but Cain continued to flee and escaped.
No officers were injured.
Cain was later arrested around 6 p.m. near where the shooting took place.
He had injuries in both legs, presumably from the exchange of gunfire, and
was taken to the hospital for treatment.

18 | OCTOBER 2017 ADAIR COUNTY Presumed Innocent Until Proven Guilty
We often receive calls asking if there is a price to keep
someone out of our publication. The short answer to that
question is NO! OK Jailbirds has never accepted money
or favor to not publish a photo.
We hear many times from people that the arresting officer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. This
is NOT true. We feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.
Thank you and God Bless

A Ponca City man has been charged in the hit
and run death of a tribal elder and a spiritual leader with the Otoe-Missouria Tribe.
Antonio Reyes, Jr., 49, was charged August 28
with felony leaving the scene of a fatality accident
in Noble County District Court.
According to reports, Randall Whitehorn, 64, of
Red Rock, was having car trouble near Yearling
Road, south of Marland, on S.H. 177, and was
pushing his vehicle on the shoulder when he was
struck by another vehicle on July 9. The other vehicle did not stop.
After investigating the accident, Kay County
deputies arrested Reyes on August 22 and he was transported to the Noble County jail. His bond was reduced from $50,000 to $25,000 and his
preliminary hearing is set for November 6 at 1:30 pm.

22 | OCTOBER 2017 MUSKOGEE COUNTY Presumed Innocent Until Proven Guilty
25-year-old Anthony Garcia thought that he had just committed the perfect crime
and got away with it. In 2004, the gang member robbed a liquor store in California.
During the heist, he fatally shot the store owner and was on the run for the next four
years. In 2008, he was picked up for driving on a suspended license. While having
his mugshot taken, a police officer noticed the detailed tattoos across his chest. The
officer connected the dots and discovered that Garcia was the gunman in the 2004
shooting. Thankfully, Garcia spent years perfecting his tattoos, which also gave officers the crime scene in pretty exhausting detail. Garcia was convicted of first-degree
murder and could face life in prison for the crime.
Mario Garcia, 39, and Domingo Garcia-Hernandez, 28, planned to rob a West Rogers Park restaurant. The men entered the restaurant and demanded food but when
the owner told them he was too busy, Garcia-Hernandez said, “I will kill you, I have a
gun with me’’, according to a police report. The masterminds were also using squirt
guns to intimidate the owner. After the owner requested them to return in an hour, the
two men obliged to his request. Meanwhile, the owner informed police, who arrived
on scene to investigate the matter. As the police were preparing the investigation
report, Mario and Domingo returned with their squirt guns; who were apprehended
by police on spot. The men were charged with one count of attempted aggravated
robbery each.
Mauricio Fierro drove a stolen car to rob a pharmacy. Fierro left the car running for
his quick getaway and went in to rob the store. Little did he know, as he was robbing
the store, another thief sprinted over to the vehicle and took off in it. When Fierro exited the store with his bag full of money, he was stunned to discover that his getaway
vehicle was gone. Fierro, angry and short on time, started looking around to find another getaway vehicle; when another man ran by, grabbed his loot and took off. Fierro
was furious with the situation and decided that he deserved some justice. He went to
the police station to report his car and loot being stolen. There, he came across the
pharmacy owner who was making a report about the robbery. The owner recognized
him and informed the police, who apprehended him. When local news stations heard
of the story, they requested authorities to interview him; which they allowed. During
the interview, Fierro complained about the “insecurity” of the city and how he was not
able to enjoy the car he had robbed, which cost him “a lot of blood, sweat and tears”
to attain.
Matthew Allan McNelly and Joey Lee Miller decided to break into a man’s house
in Carroll, Iowa. They had a well-planned strategy ready to be executed but the only
problem was that their strategy was only as good as their IQ’s. The two men decided to conceal their identity in an unusual way. They decided to use no ski masks or
stockings pulled over their heads; not even hoods to cover their face. The pair instead
streaked their faces with permanent black marker. After both men fled the house, the
owner informed the police, who quickly arrived at the scene. Luckily, the officers pulled
over a car that matched the description and the strange disguise made it easier for
officers to identify the culprits. Both men were charged with attempted burglary, and
McNelly was charged additionally with operating a vehicle while intoxicated.

publishing more in each month’s issue.
Tips for Parents:
• Practice basic safety skills with your children. Make an outing
to a mall or a park a “teachable” experience in which your
children can practice checking with you, going to the restroom
with a friend, and locating the adults who can help if they need
assistance. Remember that allowing your children to wear
clothing or carry items in public on which their name is displayed
can bring about unwelcome attention from inappropriate people
who may be looking for a way to start a conversation with your
children.
• Remember that there is no substitute for your attention and
supervision. Being available and taking time to really know and
listen to your children helps build feelings of safety and security.
