911 Call Leads to FEDERAL Indictment
on Explosive and Gun Charges
Philip James Heath, 51, of Lawton, has
been charged in a two-count indictment with
being a felon in possession of both explosives
and firearms, announced First Assistant U.S.
Attorney Robert J. Troester.
On February 4, 2019, Heath was charged
by complaint with possession of firearms after a felony conviction. According to an affidavit executed by a special agent with the
Bureau of Alcohol, Tobacco, Firearms, and
Explosives, on the morning of January 30,
2019, officers of the Lawton Police Department responded to a 911 call regarding a
domestic disturbance at an apartment. The
woman who made the call allegedly told the
dispatcher Heath had pointed a gun at her
and threatened her. The complaint explains
that after the responding officers detained Heath, they saw the buttstock of a
rifle in plain view, sticking out from between a mattress and box springs. They
are alleged ultimately to have discovered three pistols and two rifles. Because
of items discovered in the apartment, numerous FBI personnel responded immediately to assess and mitigate any threat and to ensure public safety.
After several weeks in Comanche County custody on state charges, Heath
was transferred to federal custody in early March. On March 11, U.S. Magistrate Judge Gary Purcell ordered him held in the custody of the U.S. Marshals
Service pending trial.
On April 3, a federal grand jury returned a two-count indictment that alleges
not only illegal possession of firearms, but also illegal possession of explosives, which under the relevant criminal statute includes detonating cord. The
indictment seeks forfeiture of five firearms, 1,404 rounds of various kinds of
ammunition, and two lengths of detonating cord.
If found guilty of either count, Heath faces a potential penalty of ten years in
prison, a fine of $250,000, and three years of supervised release.

We hear many times from people that the arresting officer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. This
is NOT true. We feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.

A Duncan man who allegedly admitted to
shooting up his brother’s home told an officer he
did it, because he “ain’t no bitch.”
On March 13, at approximately 1:41 a.m., a
Duncan officer was dispatched to the 600 block
of North First Street to investigate reports of
gunshots in the area. He was flagged down by
some nearby residents who said that they heard
gunshots outside their north windows. The back
window of their vehicle had been shot out, and
the officer noticed bullet impacts on the front
windshield.
While investigating the scene, the officer heard
more gunshots coming from the east. He saw
a vehicle drive slowly southbound on B Street,
then speed off eastbound on Pine. Another officer took off after the car.
Shortly after, the reporting party told police that his brother, 25-year-old Jacob Austin Berry, had just come home and said officers were looking for him
because he shot up his brother’s house. Officers went to the residence and
met with Berry, who told them he knew he was going back to prison. When
they asked him why, he replied, “I shot up my brother’s house because I ain’t
no bitch.”
The man advised that he no longer had the weapon because he threw it
out near the house he shot. Officers found the 9mm gun in an alley on Pine
between B Street and C Street.
Berry also told officers that he fired several more rounds at B Street and
Pine after shooting his brother’s car because he wanted police to know it was
him.
Berry is being charged with use of vehicle to facilitate intentional discharge
of weapon. His bond was set at $150,000, and he is scheduled to appear in
court on May 8, 2019.

A man was arrested after throwing a brick into the plexiglas window of a jewelry store...the brick bounced back, hit him in the head and knocked him cold
until the police got there.
Police interrogated a suspect by placing a metal colander on his head and
connecting it with wires to a photocopy machine. The message “He’s lying”
was placed in the copier, and police pressed the copy button each time they
thought the suspect wasn’t telling the truth. Believing the “lie detector” was
working, the suspect confessed.
Burglars in Maryland tried to cut through a safe using a Laser Tag gun.
When two service station attendants refused to hand over the cash to an
intoxicated robber, the man threatened to call the police. They still refused, so
the robber called the police and was arrested.
Police in Los Angeles had good luck with a robbery suspect who just couldn’t
control himself during a lineup. When detectives asked each man in the lineup
to repeat the words, “Give me all your money or I’ll shoot,” the man shouted,
“That’s not what I said!”
In a small town of 1700, a student attempted to rob the local convenience
store wearing his letterman’s jacket. He did not realize that he was the only male
named Dana in the whole town.
A company called “Guns For Hire” stages gunfights for Western movies, etc.
One day, they received a call from a 47-year-old woman, who wanted to have
her husband killed. She got 4-1/2 years in jail.
Mexico - A group of drug traffickers cleverly decided to use a propane tanker
to cross the border from Mexico to El Paso, Texas. They released the propane
and concealed it within the truck 6,240 pounds of marijuana. The men did not
realize, however, that they had misspelled the name of the gas company.

An Apache man was taken into custody after an
investigation found he was in possession of child
pornography.
Dave Olen Carter, 64, was charged March 15
with possession of juvenile pornography in Caddo
County District Court
The OSBI stated agents arrested Carter at his
home in Apache without incident.
Cater had been under investigation for about
a year on what was originally a child molestation case, according to reports. Last year, OSBI
agents confiscated his computer and found child
pornographic images on the hard drive. Some
of the children were believed to possibly be as
young as one year old.
Carter’s bond was set at $250,000 and his preliminary hearing is set for
May 6.

We often receive calls asking if there is a price to keep
someone out of our publication. The short answer to that
question is NO! OK Jailbirds has never accepted money
or favor to not publish a photo.
We hear many times from people that the arresting officer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. This
is NOT true. We feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.

Altus man David W. Sherwood, 60, was put behind
bars after he allegedly made threats toward an off duty
police officer during a road rage incident on March 4.
Reports state that the incident happened near the
intersection of East Tamarack and North Park Lane.
Sherwood told investigating officers that the other
driver, who was identified as an off duty Altus police
officer, suddenly changed lanes in front of him. This
enraged Sherwood, who flashed his headlights and
honked at the other driver.
The off duty officer pulled over and stepped out of
his vehicle. He recognized Sherwood from previous encounters and knew
that the man carried a gun.
The two men started arguing, and the off duty officer said he saw Sherwood reach toward his side and put his hand on a gun.
The officer also reached for his gun. Sherwood told him, “You better get
out of here or it’s going to get bad for you.”
The officer then left the scene to prevent further escalation.
Sherwood is being charged with threaten to perform act of violence. He
was released on a $750 bond and is scheduled to appear in court on May
2, 2019.

April is National Child Abuse Prevention Month, a time to recognize that we each can play a part in promoting the social and
emotional well-being of children and families in communities.
Parenting is one of the toughest and most important jobs
in America, and we all have a stake in ensuring that parents
have access to the resources and support they need to be successful. Entire communities play a role in helping families find
the strength they need to raise safe, healthy, and productive
children.
Here are some things you can do:
Get to know your neighbors. Problems seem less overwhelming when support is nearby.
Help a family under stress. Offer to babysit, help with chores and errands, or suggest
resources in the community that can help.
Reach out to children in your community. A smile or a word of encouragement can mean
a lot, whether it comes from a parent or a passing stranger.
Be an active community member. Lend a hand at local schools, community or faithbased organizations, children’s hospitals, social service agencies, or other places where
families and children are supported.
Keep your neighborhood safe. Start a Neighborhood Watch or plan a local “National
Night Out” community event. You will get to know your neighbors while helping to keep your
neighborhood and children safe.
Learn how to recognize and report signs of child abuse and neglect. Reporting your
concerns may protect a child and get help for a family who needs it.

A 911 call led to Chickasha officers kicking
down a door to stop an alleged rape on March 23.
According to reports, officers were dispatched
to a home in the 700 block of North 11th Street
around 11:30 a.m. after a woman called 911 and
reported a rape. The call was traced to the residence.
When officers arrived, they kicked down the
back door of the home.
The victim said she and 46-year-old Chickasha
man Anthony Torralba had been involved in a relationship.
During the ordeal, the victim told police Torralba
assaulted her and held a knife to her throat.
Torralba is being charged with rape in the first degree and forcible sodomy. His bond was set at $250,000, and he is scheduled to appear in court
on May 1, 2019.
