KEEPING HOUSE
Marlow duo Ashley Valdez, 24, and 23-yearold Dylan Mark Elroy, were arrested after officers
caught them burglarizing a home in the early
morning hours of August 1.
According to the affidavit, Marlow officers
were contacted at approximately 3:59 a.m. by
the homeowner, who said his phone had gone
off, indicating that someone was inside was his
residence.
When officers pulled up to the residence in
the 500 block of North Second Street, they saw
flashlights moving around the house. The backdoor had also been kicked in.
Officers waited outside the backdoor and a
person wearing a hoodie, some latex gloves and
a bandana on her face walked outside. The person was also carrying a large blue bag.
An officer shined his flashlight on the person,
later identified as Valdez, and ordered her to
the ground. Another officer spotted a man also
wearing a hoodie and latex gloves with pantyhose on his face jump out of a window.
Both Valdez and the man, identified as Elroy,
were placed under arrest and transported to jail.
The blue bag that Valdez had been carrying
had the homeowner’s name on it. Inside, there
were Xbox and Playstation games, a speaker,
household items, a thermos, ear muffs and music electronics that the
homeowner identified as his.
At the jail, Valdez told police Elroy told her that he had kicked in the
backdoor of the residence, and asked if she wanted to rob the place with
him. Valdez said she was mainly looking for household items she could
use.
Valdez informed officers that her car was still parked in the backyard of
Elroy’s residence, also in the 500 block of N. Second Street, but she assured them there was nothing illegal inside.
When police searched the vehicle, they found methamphetamine and a
set of digital scales.
Elroy later told officers that he was that the back door was open to the
residence, so he threw on some gloves and the mask and went inside.
Elroy gave officers permission to search his residence. They found a
homemade smoking device used for meth in his bedroom.
Both Valdez and Elroy are being charged with burglary in the second degree and possession of controlled dangerous substance. Both are scheduled to appear in court on September 13, 2017 and their bonds were set
at $25,000 each.

The body found northwest of Frederick on
August 22 has been identified as Jared Allen
Holmes of Altus.
Investigators believe Marielle Trey Smith, 24,
was involved in his death and a warrant charging
him with murder, second degree, was issued on
August 21. According to reports, Smith allegedly
shot Holmes several times at a home in Altus and
dumped the body in a creek a mile northwest of
Frederick.
Smith is described as a black male, 24 years
old, about 5’6” and 200 pounds. He has several
tattoos on his arms, chest and back, as well as on the left side of his neck.
He may be driving a 2007 White Dodge Charger with stripes on it and the
tag D-N-T 166 OR the victim’s car, a 2002 black Chevy Tahoe, tag number
900 L-U-K. If you have any information about his whereabouts, you are
asked to call the Altus Police Department at 580-482-4121 or their local
law enforcement agency.

Q: Can you tell our readers what the Oklahoma
State Legislature has done or is doing to help eliminate opioid addiction?
A: I was reading the other day that Oklahoma is
in the middle of a “cultural shift” with opioid addiction. What has traditionally been viewed as poor life
decisions is being increasingly seen as a brain disease. There are more and more studies supporting
such evidence, and the Legislature wants to do everything it can to eliminate the drug addiction that
harms our state. Unfortunately, we were unsuccessful this session with
passing a bill that would’ve allowed licensed pharmacists to prescribe Naloxone, which helps combat drug overdoses. There are two versions of the
bill, and I’m hopeful we’ll see passage next year.
I am thankful, though, that Attorney General Mike Hunter has started
cracking down on physicians who overprescribe as well as pharmaceutical companies who mislead physicians about opioid use. It’s a good thing
when the executive and legislative branches can work to combat such a
critical issue.
Q: Has House Bill 1482 adding a provision to State Question 780 been
passed by the Senate yet?
A: HB1482 actually stalled in the Senate, but it’s possible it will be taken
up again once the Legislature resumes in February.
Q: What is your position on Oklahoma State Question 788?
A: It would be inappropriate for me to lobby for or against the state
question because I am a state representative. However, I can say that I
am thankful we have a process for citizens to get issues on the ballot. The
initiative petition process worked exactly as intended here, and I’m looking
forward to seeing how Oklahomans cast their vote on State Question 788.
Q: Is there anything else that has happened in this past legislative session that would be interesting to our readers?
A: While session only technically lasts from February until May, policy
talks occur year-round for lawmakers. We will begin working in specific
policy groups this fall to shape next year’s bills, and interim studies will
ramp up beginning in August. I would not be surprised to see more opioid-related legislation introduced in the coming sessions.

FORMER PRISON GUARD CHARGED
WITH CONSPIRACY, BRIBERY
An indictment was unsealed August 23
charging Charles Daniel Lynn, 34, of El Reno;
Armondo Tabares, 30, of Mission, Texas; and
Jose Tomas Castillo-Garza, 39, currently an
inmate in United States Bureau of Prisons
custody, with conspiracy to commit wire fraud
and bribery, announced Mark A. Yancey, United States Attorney for the Western District of
Oklahoma.
On August 16, 2017, a federal grand jury
returned an indictment alleging that Lynn was a
correctional officer at Great Plains Correctional
Facility, a Federal Bureau of Prisons-contracted low-security facility in Hinton. Great Plains
houses over 1,800 federal inmates.
The indictment alleges that in the summer or early fall of 2016, inmate
Castillo-Garza asked Lynn to smuggle cell phones into the facility. Lynn
and Castillo-Garza allegedly agreed that Lynn would be paid thousands
of dollars by wire transfer in exchange for his smuggling of cell phones
and other contraband into the facility. The indictment further alleges Castillo-Garza arranged with Lynn to have Castillo-Garza’s brother-in-law, Tabares, send wire transfers and contraband to Lynn.
According to the indictment, Castillo-Garza and/or other inmates working with him threatened another inmate’s safety to secure that inmate’s
promise to arrange for money to be wired to Lynn outside the facility. Castillo-Garza is alleged to have coordinated with another inmate to have additional funds sent to Lynn. In total, approximately $7,750.00 was sent to
Lynn as bribes to smuggle contraband into the facility, according to the
indictment.
The indictment states that Tabares and Lynn communicated about the
types of contraband to be smuggled and that Tabares purchased the materials and sent approximately 8-9 packages to Lynn between October
and December 2016. After Lynn received the packages, he smuggled the
items, including cell phones, into the facility and delivered the items to
Castillo-Garza, according to the indictment. It is also alleged that Lynn
escorted Castillo-Garza to various parts of the facility to distribute the contraband to other inmates.
Count 1 charges all three defendants with conspiracy to commit wire
fraud. If convicted, defendants each face up to 20 years in prison and a
$250,000.00 fine. Count 2 charges Lynn with accepting a bribe as a public
official, and Count 3 charges Castillo-Garza and Tabares with bribing a
public official. If convicted on the bribery counts, each defendant faces up
to 15 years in prison and a $250,000 fine.

MURDER WARRANT
ISSUED FOR SMITH
A warrant for second-degree murder was
issued August 21 for Marielle Trey Smith.
Smith is the suspect in the murder investigation by Altus Police of Jared Allen Holmes,
whose body was found outside of Frederick
on August 22. According to reports, Smith allegedly shot Holmes several times at a home
in Altus and dumped the body in a creek a
mile northwest of Frederick.
Smith is described as a black male, 24
years old, about 5’6” and 200 pounds. He
has several tattoos on his arms, chest and
back, as well as on the left side of his neck.
He may be driving a 2007 White Dodge
Charger with stripes on it and the tag D-N-T
166 OR the victim’s car, a 2002 black Chevy
Tahoe, tag number 900 L-U-K. If you have
any information about his whereabouts, you
are asked to call the Altus Police Department

patients about addiction. If not, ask for a referral to another doctor with more
expertise in the area of addiction. There are 3,500 board-certified physicians
who specialize in addiction in the United States. The American Society of
Addiction Medicine website has a Find a Physician feature on its home page.
The American Academy of Addiction Psychiatry also has a Patient Referral
Program.
Emphasize to your friend or loved one that it takes a lot of courage to seek
help for a drug problem because there is a lot of hard work ahead. There is a
great deal of scientific evidence that treatment works, and people recover every day. Like other chronic diseases, addiction can be managed successfully.
Treatment enables people to counteract the powerfully disruptive effects of
drugs on the brain and behavior and to regain control of their lives. Like many
diseases, it can take several attempts at treatment to find the right approach.
But assure your friend or loved one that you will be supportive in his or her
courageous effort.

CHICKASHA MURDER CASE
A dispute over a cell phone and drugs led to a Chickasha man’s death and two other men in jail for his murder.
Steve Lail, Jr., 28, of Blanchard, and Rico Doss, 20,
of Chickasha, were charged August 17 with murder,
first degree, in Grady County District Court.
According to OSBI, just after 5:30pm on August 10,
police were alerted to shots having been fired inside a
home at 420 E. Ada Sipuel in Chickasha. When officers
arrived on scene, they found 45-year-old Dan C. Beal,
III dead inside. The Chickasha Police Department called
OSBI for investigative assistance. Numerous OSBI
agents were on the scene interviewing individuals, collecting evidence, and documenting the crime scene.
Agents arrested Lail on August 11 at his home near
Blanchard, and on August 15, agents arrested Doss.
Reports state Doss possibly traded his cell phone for
drugs and then conspired with Lail to get the phone
back “by force if necessary.” Lail allegedly told agents
that he “emptied his clip” on Beal.
Bond was denied for both men. Doss is scheduled to appear in court for his
preliminary hearing conference on September 6 at 1:30 pm. Lail is scheduled
to appear for his preliminary hearing conference on October 4 at 1:30 pm.
