Presumed Innocent Until Proven Guilty PAYNE COUNTY 5 | AUGUST 2020
ripley Man Sentenced to More Than 10 Years for
Possession of Multiple Firearms and Amm unition
Brandon Todd Hatchett, 46, of Ripley, has been
sentenced to 130 months in prison for possessing seven firearms and ammunition after having
been previously convicted of a felony, announced
U.S. Attorney Timothy J. Downing.
On June 19, 2019, Hatchett was charged by
superseding indictment with one count of being a
felon in possession of firearms and one count of
being a felon in possession of ammunition. The
superseding indictment set forth seven firearms
that Hatchett possessed, including two AR-15
style rifles.
On October 13, 2019, Hatchett pled guilty to
both counts of the superseding indictment.
On July 1, 2020, U.S. District Judge Timothy D.
DeGiusti sentenced Hatchett to 120 months in prison on the firearms count,
to be followed by 10 months of imprisonment on the ammunition count.
Judge DeGiusti also imposed three years of supervised release.
According to evidence at sentencing, on April 5, 2019, Hatchett pulled up
to a residence in Ripley armed with an arsenal of weapons and ammunition
sitting beside him in the cab of his truck. Hatchett engaged in a confrontation with an individual at the residence, which led to a car chase through Main
Street in Ripley. During the chase, Hatchett pulled his truck alongside the
passenger side of the other vehicle where he fired multiple rounds from his
AR-style rifle into the other vehicle. Shrapnel from one of the rounds struck
the driver in the leg. Following the shooting, the Payne County Sheriff’s Department organized a manhunt for Hatchett. He was later arrested by the
Logan County Sheriff’s Department. At the time of his arrest, Hatchett had all
seven firearms in his possession.
On April 20, 2019, the Payne County Sheriff’s Department learned that
Hatchett had purchased additional rounds of ammunition from a Walmart
store. Hatchett was again arrested and held pending sentencing on both
offenses.

Stroud man sentenced in case of
stolen calves
Clarence Henry Burger, a 50-year-old man
from Stroud, pleaded guilty to larceny of domestic animals in May following an investigation led by Texas and Southwestern Cattle
Raisers Association Special Ranger Bart
Perrier. Burger, who also goes by the name
Festus, was sentenced to seven years (suspended sentence) and was ordered to pay a
total of $4,123.33 in restitution to the victim.
The defendant also was ordered to serve a
total of 14 days in the Creek County Jail and
must pay a $500 fine, along with assorted
court costs.
Burger was arrested August 5, 2019, on
criminal charges filled within the District Court
of Creek County. Perrier said Burger stole seven head of mixed calves and
one cow from an absentee landowner who had hired him to manage his
ranch. The victim, who resides in the Dallas-Fort Worth metroplex, became
suspicious Burger had stolen from him during the spring of 2019. Perrier was
able to confirm his suspicions and prove Burger sold the animals at livestock
markets in Bristow, Oklahoma, and Perkins, Oklahoma, from June 2017 to
January 2019.
Perrier said the outcome is especially welcome during the pandemic.
“Cattle raisers, like everyone else, are facing unprecedented times,” he
said. “The last thing you need during a time of great market volatility is to have
theft threaten your livelihood, too.”

10 | AUGUST 2020 Presumed Innocent Until Proven Guilty LINCOLN COUNTY
CHARGES FILED IN 1985 MURDER CASE
Attorney General Mike Hunter has filed firstdegree murder charges in a 33-year-old cold
case involving a brutal murder in Lincoln County.
Paul Aikman, 35, was stabbed to death at
a rest stop on the Turner Turnpike in September 1985. At the time of the murder, Oklahoma
State Bureau of Investigation’s (OSBI) agents
collected cigarette butts from the crime scene,
along with latent prints. A DNA profile was developed from one of the cigarette butts, however the case eventually went cold.
Last year, OSBI criminalists at the Forensic
Science Center notified agents that during a
search of CODIS, the national DNA database,
a potential DNA hit was obtained and matched
to 55-year-old Earl Wilson. Criminalists then
matched the latent print impression taken from
the crime scene to Wilson.
“Advances in DNA technology are allowing authorities to take another look at
these difficult cases,” Attorney General Hunter said. “Just because cases go cold
doesn’t mean someone shouldn’t be held responsible, even after three decades.
I appreciate OSBI Director Ricky Adams, who has put a priority on these cases
through the development of the Cold Case Unit.”
Wilson, 55, is currently incarcerated in Oklahoma Department of Corrections
custody for unrelated crimes.
“For 35 years, Paul Aikman’s family has ached not knowing who was responsible for his murder,” said OSBI Director Ricky Adams. “35 years have passed,
but we have not forgotten about Paul. Thanks to science and determined police
work by OSBI agents and our Cold Case Unit, we are pleased to announce that
the suspect in Paul’s murder has been identified. I would like to give thanks to Attorney General Hunter and his staff for taking this case, filing a murder charge and
giving a voice to Paul and his family.”
This is the fourth cold case that has resulted in charges being filed since the
OSBI Cold Case Unit began work in November of 2018.

No liberty at Liberty Lake
An OKC couple who went to Liberty Lake for
some fun in the water ended up having no fun
behind bars after an officer found drugs and a
stolen vehicle in their possession on July 15.
According to the affidavit, an officer was
patrolling around the lake when he saw a car
parked in the grass at approximately 5:54 p.m.
Due to that being a violation of lake rules, he
approached the campsite.
A man, identified as 26-year-old David Eugene Atchley, stepped out of the driver’s side
of the vehicle. He showed the officer a blank
permit and said he would go pay.
The officer asked Atchley and a female passenger for ID. The passenger handed over an
ID that belonged to another woman, but she
was later identified as 29-year-old Leeandra
Lynn Newton.
The officer checked their information through
dispatch and was advised the vehicle had been
reported stolen. He also asked Newton about
her ID. She admitted that she lied, because she
had warrants for her arrest.
Atchley told police Newton had picked him
up in the vehicle the night before. Newton told
police she met with the woman whose name
was on the ID the previous night in Oklahoma
City. The woman agreed to let her use the vehicle, so Newton picked
up Atchley and drove to Guthrie. She said she couldn’t call the woman
because she didn’t have service. She communicated with the woman
through Facebook messenger when she had WiFi.
While searching the vehicle, officers found a marijuana cigarette under
some men’s shorts. In one of the pockets, they found a vial of loose weed.
Atchley said the shorts were his, but the marijuana wasn’t.
Officers also found some cut straws, more marijuana, scissors with residue, rolling papers and a bag with residue in the vehicle.
Neither suspects had a medical marijuana card.
Atchley is being charged with unlawful possession of marijuana and unlawful possession of drug paraphernalia. His bond was set at $2,500, and
he is scheduled to appear in court on August 13, 2020.
Newton is being charged with unauthorized use of a motor vehicle, obstruction of an officer and unlawful possession of controlled dangerous
substance. Her bond was set at $20,000, and she is scheduled to appear
in court on August 27, 2020.

What’s wrong in the world today
A Ponca City man allegedly hurled racist
and sexist insults at a store manager after
she asked him not to refill a cup due to COVID-19.
According to reports, the incident happened on July 14 when 58-year-old William
Leonard Welch tried to take a refill cup into
Casey’s General Store.
Due to the current pandemic and the store’s
action to reduce the spread of the virus, the
store has policies in place that prevent customers from using self-service machines. The
policies are to help protect the business’ customers and employees.
Even though Casey’s is not the only store to
put such policies into place right now, Welch didn’t take too kindly to doing
his part to stop the transmission of coronavirus.
When a manager informed him that he couldn’t bring a refill cup into the
store, he became belligerent and started yelling insults at her.
Reports state those insults included bitch, a racial slur and other derogatory
terms.
Welch also flipped off the manager when she told him to leave and not to
come back. He also allegedly told the manager that she “should hang just like
the rest of the n------.”
The man then jumped in his truck and left the scene.
Officers were called to the store and reviewed video footage of Welch’s
angry tirade against the manager. He was arrested on July 21.
Welch is being charged with outraging public decency. He was released on
a $5,000 bond and is scheduled to appear in court on July 31, 2020.
