A Ponca City woman faces felony
charges after she tried to use the postal
system to sell her drugs April 24.
That day, Ponca City police officer
Nathan Loe received a report from
a woman who works at a local Fedex
shipping desk. The woman said at 1:30
p.m., Monica Garcia, 40, came in to
ship a package, but her name didn’t
match the shipper’s name on the box.
Garcia was acting suspicious, so
the employee decided to inspect the
package. Inside, she saw a plastic bag
wrapped in foil, which was concealing
methamphetamine, she said.
An hour later, Garcia called the Fedex to ask why her package
hadn’t been shipped out. Another employee found out the situation,
so she enlisted some police backup to help set up a sting at the office.
The employee told Garcia her package was misplaced and she had to
come back and re-sign for it.
Once Garcia came back, the employee told her an officer on scene
was her supervisor. Once Garcia signed the slip, the officer revealed
himself and asked her where she got the package. Garcia picked it up
from “some guy” on the street in Blackwell, and she was shipping it
for him, she said.
During booking, detention officers also found she had Temazepam
pills and $143 on her. In an interview, she admitted she was trying
to sell drugs, saying she picked the methamphetamine up in Wichita,
packaged it and tried to ship it via Fedex.
Loe later determined Garcia tried to ship 27 grams of methamphetamine, which earned her a drug trafficking charge.
Garcia is due in court at 2 p.m. July 12. She remains in custody on
a $150,000 bond.

An ordinary traffic stop didn’t end so
well for a Bartlesville pair May 13.
That day, officer Steven Silver, a narcotics investigator, was driving westbound on 20th Street behind a blue
Ford SUV, when he saw the Ford fail to
signal before making a right turn. Silver
initiated a traffic stop and found Joshua
Eastham, 18.
Silver recognized Eastham from previous experience, so he asked Eastham
to get out of the car to talk to him. Once
Eastham opened the door, Silver became overwhelmed with the smell of
marijuana from his clothes and inside
the SUV. Despite this, Eastham denied having illegal drugs on him.
Next, when Silver asked Eastham for ID, Eastham said he didn’t
have a driver’s license. At that point, he was detained, and Silver
later determined Eastham’s license was suspended. The officer put
Eastham in the patrol car and tried to get him to talk about the incident, but Eastham refused to say many details. However, he did
say his passenger, Whitney McLain, “doesn’t know about anything
in the vehicle.” He also said “it’s behind her seat,” prompting Silver
to search the SUV.
Sure enough, Silver found a black trash bag concealing marijuana.
There was a small hole in the bag, which revealed another black bag.
Silver tore a hole in the second bag and saw multiple bricks of marijuana, which weighed nearly 10 pounds.
A further search of the SUV turned up three smartphones, which
were taken into evidence. Silver also arrested McLain, saying she
likely knew about the drugs because of the strong smell.
While en route to the jail, Eastham spilled the beans on the deal,
saying, “You guys shouldn’t have stopped looking so fast. I can’t believe you guys were letting an 18 year old run this drug operation.”
Eastham posted $50,000 bond May 15, and McLain posted
$25,000 the same day. They have court set for 9:30 a.m. June 7.

Oklahoma Highway Patrol
Oklahoma has a lot of rural
areas, and is crisscrossed with
county roads. In those rural areas,
these county roads are traveled extensively, and as a result, around
50% of all accidents occur on them. The majority of those are due to
unsafe speeds. Most of these roads don’t have a posted speed limit,
so how is a driver to even know what the legal speed is? I’m going
to try and give some insight into that.
First, by state law, the speed limit on all county roads in the
state that aren’t otherwise posted is 55 miles per hour. Wait, you
might say...I heard the speed limit in my county on county roads
is 35, or 45. You are probably correct. The reason some counties
have a speed limit that is different on their county roads is because
the Board of County Commissioners for that county can set by
resolution a maximum speed limit for their roads. So how do you
know what the speed limit is for each county?
Posted on the county line marker, wherever a state highway
enters a county, and at all off-ramps where Interstates or Turnpikes
enter a county, there is a sign advising the driver of the speed limit
for non-posted county roads which will read as follows: ENTERING
________ COUNTY, COUNTY ROAD SPEED LIMIT _____MPH
UNLESS POSTED OTHERWISE.
Keep your eyes out next time you cross a county line, and see if
you see a sign like this, because they are out there. Now, if you don’t
see the signs, that means that in that particular county, the County
Commissioners did not change the speed limit on those county
roads, and the speed limit is 55 MPH as set by state law. For those
of you that would like to see this information, you can find it in the
Oklahoma State Statutes, Title 47-11-801F.
Now that we know the speed limit on these roads, lets talk about
the unsafe speeds that usually result in accidents. Most are due to
driving too fast on the type or roadway, specifically gravel, or on a
curve or turn. Just because the speed limit is 55, doesn’t mean that
you have to go that fast, and you should adjust your speed to the
conditions...if its gravel, and you are sliding around, you are going
too fast. Gravel is tricky, it doesn’t have the same grip as pavement,
and the depth and type of gravel all play a role in the traction you
have, which affects your stopping ability. If you are unfamiliar with
the road, be aware that it could be a T intersection, or a 90 degree
turn on the back side of a hill... adjust your speed to your abilities,
the conditions present, and potential conditions you may not know
about!

choice. But as soon as you get behind the wheel then

with dinner then eat dinner at home or have someone
else drive.

driving at .05. It’s called driving while impaired (dwi)
apparently none of you know this.

should have to follow the same dot rules i have to

having early release programs. This is about like trying

The NTSB (National Transportation Safety
Board) is looking into lowering the legal limit
for drunk driving from its current BAC .08 to a
lower tolerance of BAC .05 They say this move
could save many lives each year. Tell us what
you think of this plan!

A simple traffic stop went way wrong
for a Pawhuska woman who was riding
in the passenger’s seat.
On May 17, an officer with the
Pawhuska Police Department noticed
that a black truck driving down the
road was missing the right front headlight. The officer pulled the truck over
and the driver told the officer that his
driver’s license should have been reinstated, but he had not yet received it
in the mail. After confirming what the
driver told him, the officer cited the
driver for the violation and the truck
was towed.
According to the police report, the passenger of the truck, 21-yearold Trisha Carolyn Cherry, had difficulty answering simple questions, slurred speech and bloodshot eyes. The officer asked Cherry
if she had anything in her purse he should know about and she told
him there might be some zig zag rolling papers in it.
The officer looked in her purse and found a yellow pill, which later
tested positive as Clonazepoam. He asked Cherry if she had a prescription for it and she told him no. The officer also found a small,
clear bag that tested positive for meth.
During this time, the officer found that a city warrant had been
issued for Cherry’s arrest. Another officer transported Cherry to the
Osage County Jail. During a search of Cherry during the booking,
staff found a straw in her bra that contained a white powdery residue. The booking officer then searched his patrol car and found a
black bag containing two more yellow pills and a small bag of meth
under the seat where Cherry had been seated.
Cherry was booked into jail on a $5,000 bond for two counts of
possession of controlled dangerous substance and unlawful possession of drug paraphernalia. She is scheduled to appear in court on
June 14, 2013.

William Elvis Duff, 63, of Mannford, was taken into custody on
May 14 by the Pawnee County Sheriff’s Department after he admitted to sexually assaulting a woman and offering her money in exchange for sexual acts.
According to the affidavit, officers responded to a call at a Mannford residence on April 17 regarding a stolen purse containing medication. The caller accused her neighbor, who often stopped by to help
her with housework and errands, of taking the purse. When officers
questioned the neighbor about the stolen medication, she told officers that Duff, who lives at the same residence as the accuser, had
attempted to rape her the day before.
The victim was asked to go to the sheriff’s office to be interviewed
the next day and she repeated the same story as before. She said during the attempted rape,
she tried to wake up her neighbor, but said she was “loopy from her pills.” She added that
Duff had offered her money in exchange for sexual acts in the past. The victim said she told
Duff no, and he did not ask her again.
Duff was taken to the sheriff’s office and interviewed about the attempted rape allegations.
He admitted that what the victim said was true, and that he was “trying to get some.” He also
admitted to offering the victim money in exchange for sex.
Duff was booked into jail on a $25,000 bond for charges of sexual battery and soliciting
prostitution. He is scheduled to appear in court on May 28, 2013.
