Spring is a time of new
beginnings, brought about by
spring rains that start quenching
the winter thirst of all things dormant through the winter. Although
lately, things seem to have been drier than usual, I’m writing this
Tips in the hopes of maybe bringing about some much needed rain
by talking about it! If you’ve lived in Oklahoma any period of time,
you know that spring rains usually bring spring flooding, which
can significantly impact travel in the state. I’m going to talk a little
about the dangers that roadway flooding can present, and some
tips for avoiding them.
Every year that we have flooding, we get stories about
motorists who are stranded in water that has risen up over the
roadway. The news has the usual shot of one vehicle with its
hazard lights on not moving, followed by video of other vehicles
still driving through these flooded roads. The solution is very
simple, if you don’t want to be that vehicle that is stranded, don’t
drive through standing water! Most of the locations that typically
flood over in heavy rains are traditional places where this happens
year after year. The problem with this is that usually, the locals
think since they’ve been able to drive through it before, it shouldn’t
be any problem now. A lot of things can happen under water that
we can’t see though. Parts of the roadway could wash out, debris
could be covered up that can’t be seen, and other unseen hazards
could be present. All of these things can spell disaster for the
person who assumes it will be ok to drive through standing water
on the roadway.
Next, don’t drive around “Road Closed” signs. Every year
in these traditional flood areas, the public safety officials close the
roads for safety, and every year people drive around those signs
and end up needing rescued. Not only are those signs put up for
your safety, it is illegal to drive around them. They are Official
Traffic Control Devices, and as Oklahoma State Statute 47:11-201A
states: The driver of any vehicle shall obey the instructions of any
official traffic-control device...unless otherwise directed by a traffic
or police officer.
Last, be aware of your surroundings, so that you can find
an alternate route if needed. In today’s technology driven world,
this is easier than ever to do. Use that smart phone, tablet, or GPS
device to find a way around flooded areas. Also, when the potential
for floods can cause roads to be closed, give yourself extra time to
reach your destination, in case an alternate route is needed.
Hopefully, this spring will be full of showers that bring
out the green grass and flower blooms, instead of continued burn
bans. If those April showers bring those May flowers, now you’ll
have some tips for avoiding any of the pitfalls that inherently come

A Poteau man’s inability to properly use a turn signal resulted in his arrest, along with two of his passengers, who
were in possession of drugs and paraphernalia.
On March 17, a Wister police officer was on patrol when he
saw a truck approach a stop sign at the intersection of Grand
Avenue and Highland Street.
According to the affidavit, after failing to come to a stop, the
driver activated his left turn signal, then came to a stop in the
middle of the roadway before activating his right turn signal
and turning right. The officer conducted a traffic stop.
The driver, Christopher David Ables, 40, told the officer
that his female passenger was giving him directions, and
that’s why he didn’t use his turn signal properly.
The female passenger identified herself as Ceslianne Nicole
James of Poteau and told him she was born in 1989.
A male passenger identified himself as 46-year-old John
Mason Gibson of Albion.
After checking their information, the officer found that
Ables had felony warrants for his arrest. Dispatch said they
were familiar with James and her actual date of birth was in
1988.
James later told the officer that she forgot and didn’t mean
to give him wrong information. The officer found a Loratab,
a Xanax and a hydrocodone/acetaminophen in her pockets.
During a search of Gisbon, the officer found a plastic like
baggie with a substance that tested positive for meth in his
pocket.
While searching the car, the officer saw James move from where she had been standing
near the patrol car; underneath the car, he saw a syringe. James admitted that she had taken
the syringe out of her boot.
James is being charged with possession of a controlled dangerous substance, unlawful
possession of a controlled substance without a prescription, unlawful possession of drug
paraphernalia and obstructing an officer. Her bond was set at $10,000, and she is scheduled
to appear in court on April 4, 2014.
Gibson is being charged with possession of a controlled dangerous substance and unlawful
possession of drug paraphernalia. His bond was set at $3,000, and he was scheduled to appear in court on March 28, 2014.
Ables is being charged with failure to maintain security and failure to signal on turning. He
was released on a personal recognizance bond and is scheduled to appear in court on April
18, 2014.

The Bible does not specifically use the term
“child abuse.” There is no record of a single
instance in the Bible where a child is being abused.
What the Bible does tell us is this: children have
a special place in God’s heart and anyone who
harms a child is inviting God’s wrath upon Him.
When Jesus’ disciples tried to keep children from
coming to Him, He rebuked them and welcomed
little children to His side, saying, “Let the little
children come to me and do not hinder them for the kingdom of God
belongs to such as these” (Mark 10:14). Then He took the children in His
arms and blessed them (v. 16).
Children are abused and mistreated in several different ways, all of which
are abhorrent to God. Too many children are the victims of angry beatings
and other physical abuse as their parents take out their own anger and
frustration on their children. Anger is almost always sinful, and anyone
who abuses a child in anger commits multiplied sins. “An angry man stirs
up dissension, and a hot-tempered one commits many sins” (Proverbs
29:22). There is no place for unrighteous anger in the life of a Christian,
as Paul reminds the Ephesians: “In your anger do not sin: Do not let the
sun go down while you are still angry, and do not give the devil a foothold”
(Ephesians 4:26-27). Anger should be confessed to God long before it comes
to the point of physical abuse against a child or anyone else.
Psychological and emotional abuse is also forbidden in Scripture.
Ephesians 6:4 warns fathers not to “exasperate” or provoke their children,
but to bring them up in the “training and instruction of the Lord.” Harsh,
unloving discipline alienates children’s minds from their parents and
renders their instructions and corrections useless. In addition, it often leads
to sin against God, as it is difficult in the best of children to be angry and
yet not sin. Parents can provoke and exasperate their children by placing
unreasonable requirements on them, belittling them, or constantly finding
fault, thereby producing wounds that are far worse than any physical
beating can inflict. Colossians 3:21 tells us not to “embitter” our children so
they will not become discouraged. Ephesians 4:15-19 says we are to speak
the truth in love and use our words to build others up, not allow rotten or
destructive words to pour from our lips, especially toward the tender hearts
and minds of children.
So, even though the Bible does not specifically mention child abuse, it is
abundantly clear how God feels about the issue. Anyone who suspects a child
is being abused has the obligation to report it to appropriate authorities.

A series of drunk calls and texts from
Boswell man Michael Eugene Armbrister, 40, to his ex-girlfriend landed the
man in jail after he threatened acts of
violence toward her and others.
According to the affidavit, a Choctaw County deputy was dispatched to a
business in Hugo on March 21, to speak
to a woman in reference to threatening
or harassing phone calls.
The victim told him that she had received several text messages and voicemails from her ex-boyfriend, identified
as Armbrister. She said that the messages had come in during the night and early morning.
The deputy listened to two of the voicemails that Armbrister allegedly left on the victim’s phone. On one message, he threatened to kill
himself if she didn’t call him, and on the other, he threatened to kill
her and everybody in the store.
The deputy went to Boswell and made contact with Armbrister.
When he told the drunk dialer that he needed to speak with him
about some text messages and voicemails he had sent to his ex, Armbrister immediately told the deputy that he was drunk and would
never do anything to her or anybody else.
The deputy explained to him that he couldn’t just go around threatening to kill people. Armbrister told him he understood, but he was
just drunk and mad at the time.
The deputy placed Armbrister under arrest and transported him
to jail.
Armbrister is being charged with threatening to perform an act of
violence. He was released on a $2,500 bond and is scheduled to appear in court on April 28, 2014.

A Wilburton man was quickly taken to jail after his drunk
driving nearly caused him to collide with a Latimer County
deputy on March 23.
According to the affidavit, the deputy was traveling northbound on SW Damon Valley Road in Wilburton when he approached a right hand curve at the top of a hill.
As the deputy started to turn, he saw an SUV traveling
southbound in the northbound lane.
The deputy maneuvered his vehicle to avoid colliding with
the car, and all four tires of his patrol car exited the roadway.
He saw the SUV jerk back into the southbound lane of
travel.
The deputy turned around and conducted a traffic stop
on the vehicle. Apparently, the near head-on collision had
scared the driver of the vehicle, because it had come to a stop
about 200 yards from where the incident had occurred and
the driver had exited the vehicle.
The officer made contact with the driver, who identified himself as 33-year-old Branden
Lee Bonham. As the deputy spoke with Bonham, it soon became apparent what was at fault
for his crazy driving
Bonham appeared very unsteady on his feet and was swaying side to side. The deputy could
also smell the odor of alcohol when Bonham spoke to him.
He asked Bonham if he had consumed any alcoholic beverages. It was only 10 a.m. when
the crash nearly occurred, but Bonham had apparently got an early start, because he admitted
to drinking that morning.
The deputy performed filed sobriety tests on Bonham, but Bonham had trouble completing
the tasks, and in some cases, didn’t even attempt to try.
After completing the standard filed sobriety tests, Bonham told the deputy that he had a
gun in his car. The officer looked in Bonham’s SUV and found a rifle, a bag of ammunition
and a Taser.
A preliminary breath test showed that Branden’s blood alcohol level was .17.
Bonham is being charged with driving under the influence of alcohol and carrying a firearm
while under the influence. He is scheduled to appear in court on April 1, 2014.

A Melissa, Texas, man tried to evade being arrest by attempting to throw his baggie of drugs
over a fence, but he was unsuccessful and found
himself behind bars at the Pushmataha County
Jail.
On March 22, a Pushmataha County deputy was
patrolling northbound on E Street in Antlers when
he saw a motorcycle turn south onto E Street from
Fourth Street, the affidavit states.
Since the deputy failed to see a tag or any kind of
tag light on the motorcycle, he conducted a traffic stop on Fifth Street.
He advised the driver, Mark Allen Roberts, 35, why he had pulled
him over and asked for his identification. Roberts handed him an
Oklahoma identification card, and the deputy asked Roberts to have
a seat in his patrol car.
As Roberts approached the passenger door, the deputy saw him toss
something toward a fence behind him. The deputy asked him what he
had thrown, but Roberts told him he hadn’t thrown anything.
The deputy walked around to the passenger side and found a clear
plastic baggie with a white crystal-like substance on the ground behind
Roberts. He placed Roberts in wrist restraints and retrieved the baggie.
Dispatch advised that Roberts didn’t have a valid driver’s license,
but he did have a warrant out of Pushmataha County.
A field test revealed that the substance in the baggie was meth, but
Roberts told the deputy couldn’t pin the dope on him because all he
does is drink.
Apparently he was lying.
Once they were at the jail, Roberts emptied his pockets and pulled
out another baggie full of a crystal-like substance, along with a cut
straw. That substance also tested positive for meth.
Roberts is being charged with possession of a controlled dangerous substance, unlawful possession of drug paraphernalia and driving
without a driver’s license. He was released on a $10,000 bond and is
scheduled to appear in court on April 23, 2014.

Crispi likes her bacon crispy
Cameo Crispi, a 31-year-old Utah woman, was jailed
after she allegedly tried to set fire to her ex-boyfriends
home with a pound of burning bacon.
According to Naples police, officers were contacted
by Crispi’s ex-boyfriend on March 14 after she allegedly
harassed him with repeated phone calls and text
messages. The man told police that he wanted the calls
to stop and didn’t want Crispi to be inside his home.
Officers were then dispatched to the man’s home
on suspicion that she might be at the ex-boyfriend’s
residence against his wishes.
Investigators say officers arrived at the man’s home
to find smoke pouring through the front door and an
intoxicated Cameo Crispi inside.
The officer entered the home and found a wood burning stove with a fire burning
inside and several hot coals laying on the floor outside of the stove.
In the kitchen the officer found a cookie sheet loaded with a pound of bacon sitting
on top of the kitchen stove. The officer noted that the burner was set to “high” and
that the bacon was “severely burned and smoking badly.”
The officer shut down both stoves, arrested Crispi and then transported her to a
local hospital to receive a medical clearance before taking her to jail. When a doctor
at the hospital asked Crispi about what had transpired at the residence, Crispi
allegedly stated that she was attempting to start a fire in the house to get back at her
ex-boyfriend, according to the arrest affidavit.
Crispi was booked into the Uintah County Jail and charged with arson, burglary,
assault by a prisoner, interfering with an arresting officer, electronic communication
harassment and intoxication. She is expected back in court on April 14.

McAlester woman Tonya Rose Whorton, 38, was locked
up on March 23, after a traffic stop for a defective tag light revealed that there was so much more wrong with her vehicle.
According to the affidavit, a McAlester police officer was
on routine patrol when he noticed a vehicle traveling northbound on Strong Boulevard that did not have a visible license
plate lamp.
The officer conducted a traffic stop and made contact with
the driver, identified as Whorton, and her male passenger.
She couldn’t locate her insurance information and asked the
officer if she could step out of her vehicle to find it. He told
her that she could.
When the officer advised her of the stop, she told him that
she had had the brake light fixed from the last time he had
stopped her. He once again he told her it was her tag light; he
also pointed out that her license plate decals were expired.
Whorton allegedly began acting nervous and started walking back and forth around her
vehicle. She was unable to locate her insurance information.
An officer arrived on scene with a K9; the officer had his K9 complete a free air sniff around
Whorton’s car. The K9 alerted on both the passenger’s side and the drivers side of the vehicle.
Police conducted a search of the vehicle and found baggies and two hypodermic syringes,
one of which contained a clear liquid substance.
The passenger told police that Whorton had just picked him up and he was unaware of the
items in her vehicle.
Police placed Whorton under arrest and asked her if she had any drug-related items on
her person. She admitted that she had a syringe in her waistband; a Pittsburg County deputy
retrieved the syringe, which contained a clear liquid.
She told police that all of the items belonged to her, and that her passenger didn’t know
about any of them. She added that while she had been looking for her insurance verification,
she noticed a syringe and tucked it into her waistband.
Whorton is being charged with possession of a controlled dangerous substance and unlawful possession of drug paraphernalia. She was released on a $25,000 bond and is scheduled
to appear in court on April 10, 2014.

An angry Fairland woman allegedly stabbed a man after
he refused to giver her some of his prescription Xanax pills.
According to the affidavit, a Fairland police officer was
dispatched to a residence in the 400 block of E. Conner on
March 9, in reference to a stabbing that had just occurred.
When he arrived, the apparent victim of the stabbing
met him at the door. The man was bleeding from multiple
wounds on his torso and left arm. When the officer asked
him who had stabbed him, he replied, “Dawn did.”
The officer saw a woman talking on the phone in the living
room. He told her several times to drop the phone and get
on the ground, but she refused to comply. The woman,
identified as Dawn Anita Squirrel, 51, finally consented, and
the officer placed her in handcuffs and in his patrol car.
The victim told the officer that Squirrel became angry when he refused to giver her
some of his Xanax pills. He said she threw a glass of “pop” at him. When he told her he
was going to call 911, she allegedly grabbed a small knife and stabbed him on the left side
of his chest. He said he pushed her away, but she began slashing at him with the knife,
cutting him on various places on his body.
He said he was able to grab the knife, but she grabbed a butcher-style knife and hit him
on his back.
The officer spoke to Squirrel, who told him that the victim became angry at her for
no reason and slapped her on the back of the head. She said that pissed her off, so he
grabbed the knife and stabbed him to keep him from slapping her again.
When asked how the victim received his other injuries, Squirrel said she didn’t know.
She did admit that she “smacked him on the back” with the butcher knife while the victim
was waiting for police.
Squirrel is being charged with assault and battery with a dangerous weapon. She is
being held on a $25,000 bond and is scheduled to appear in court on May 1, 2014.

Slow and steady does not always win the race; in fact, slow
and steady can sometimes get you arrested.
Just ask Durant woman Autumn Elizabeth Pepperman, 23,
whose vehicle was stopped by police after she couldn’t seem to
keep up with the flow of traffic.
According to the affidavit, a Calera officer was traveling southbound on Highway 69/75 on March 21, when he saw two cars
in front of him quickly change lanes to pass a vehicle traveling
slowly in the fast lane.
Traffic was beginning to bottle up on the highway behind the
car, so the officer conducted a traffic stop near Platter Road.
The officer made contact with the driver, Pepperman, and
noticed she had a child in the backseat. When the officer told
her he stopped her for impeding the flow of traffic, she allegedly
stated, “Yeah, I figured that’s what it was.”
The officer asked her if there were any drugs in the vehicle and explained that his K9 would
be conducting a free air sniff on the vehicle. She told him that her child’s father smokes weed
and had been in the vehicle. He noticed that when he asked her about drugs, her speech had
become rapid when answering questions.
As the officer walked his K9 around the vehicle, he saw her grab her purse and put it between the driver’s side door and her leg. She also shoved a clear electronic cigarette case
under her leg.
When he asked her about the container, she didn’t respond. He grabbed the container,
and Pepperman tried to grab it back from him. Inside, he found a hand rolled cigarette that
contained a green leafy substance.
Pepperman began to cry hysterically, and he asked the officer if she was going to jail.
In her purse, he found baggies containing a crystal substance and a pill bottle that contained
crystal substance tested positive for meth, and the pills were all identified as scheduled drugs
that required a prescription. A closer look inside Pepperman’s purse revealed more pills, and
two hand rolled burnt cigarettes and a container, all full of a green leafy substance.
Pepperman is being charged with possession of methamphetamine in presence of child
under 12, possession of marijuana, possession of Xanax and unlawful possession of drug
paraphernalia. She was released on a $6,500 bond and is scheduled to appear in court on
April 2, 2014.

Atoka woman Vickie Fay Murillow, 40, found herself in even more trouble when she
took syringes into jail after she was arrested for a warrant on March 20.
According to the affidavit, an Atoka police officer was patrolling Highway 69/75
when he noticed a vehicle turn off of E. C Street and travel into the other lane of traffic.
He conducted a traffic stop at the intersection of Ninth and Highway 69/75 and made
contact with the driver, identified as Murillow. After checking her information, he was
advised that she had an active warrant.
He placed her under arrest. Before placing Murillow in the patrol car, the deputy
asked her if she had anything illegal on her person. Murillow allegedly put her head
down and paused for awhile before stating no. The deputy asked her the question
again. She once again ducked her head and said no after a long period of silence.
The deputy transported her to jail for booking and left to continue patrolling in Atoka.
The deputy later received a radio transmission from dispatch regarding Murillow.
Due to her hesitance when answering whether or not she was in possession of anything illegal, the deputy was probably not surprised when he learned that she had been lying. During booking, jail staff found five syringes on Murillow’s person. The syringes tested positive for methamphetamine.
Murillow is being charged with possession of a controlled dangerous substance. Her bond was set at $6,000, and
she is scheduled to appear in court on April 2, 2014.

An Oklahoma City attorney is facing prison time after being
arrested inside the Oklahoma County jail. The Sheriff’s office
says the investigation when a female inmate told deputies the
man she thought was her attorney was engaging in sexual acts
during visitations.
Deputies arrested Frank Kirk, 70, on Monday after setting
up a sting that caught him on audio tape with the inmate. Investigators say the inmate originally contacted Kirk in January
about representing her, but it turns out he never filed to be her
attorney of record.
“Kirk told the victim that since she didn’t have the cash to pay for his services
she could make it up to him by performing sexual acts instead,” said Sheriff John
Whetsel.
Sheriff Whetsel said the investigation revealed the Kirk only pretended to represent the woman who was in jail on drug charges. She discovered the ruse when
the public defender’s office contacted her about her case. That’s when the woman
talked to deputies and agreed to assist in the investigation.
Investigators say the woman met with Kirk inside the jail and he is heard on
audio tape making advances towards her. The sheriff’s office says the woman was
told to use the phrase “my pants are too tight” to signal deputies to enter the room.
“During his visit, Kirk furnished her with lubricating jelly and a sex toy and as this
began our investigators opened the door and arrested Frank Kirk immediately.”
According to court documents the female inmate told investigators that Kirk
coerced her into performing sexual acts while he watched at least four times.

An angry Edmond woman was placed in a rubber
room after she was arrested in McIntosh County, but
not before she unleashed a stream of spit on a deputy.
On March 22, a McIntosh deputy was on patrol when
he was dispatched on reports of an out of control individual in the Twin Mountain area, according to the
affidavit.
When he arrived, he saw a woman, later identified
as Brenda Lynn Miller, 60, yelling and beating on the
front door of a house. When she saw the deputy, she sat
down in a chair on the porch.
The deputy approached Miller and asked her what
was going on. She wouldn’t speak, so another deputy
went to speak to the reporting party. This apparently
angered Miller, who stood up and started stomping, yelling and cussing.
Despite commands from police to stop, Miller continued her erratic behavior. A deputy
told her to put her hands behind her back, and she told him, “No, you are not f------ handcuffing me.” She then kicked a deputy in the leg, grabbed the handles on a wheelchair ramp
and held on for dear life.
Police eventually pried her hand from the handles and place her in handcuffs. A deputy
escorted her to his patrol vehicle, but as they approached the car, Miller began pulling away
from him and yelling. Once police were able to get her in the car, she allegedly said, “I took
narcotics.”
On the way to the jail, Miller continued her confession. She told the deputy, “I took narcotics and smoked a bunch of pot.” She continued to yell and cuss the entire drive to jail.
Police had to escort Miller into the jail, because she refused to stand up.
Once they were in the jail, police placed her in a rubber room for her safety, but she kept
kicking and hitting the doors.
Police then attempted to place Miller in a restraint chair. She spit all over a deputy, covering him in her saliva.
He placed a spit mask on her and put her in the rubber room.
Miller is being charged with aggravated assault and battery and prisoner placing body fluid
on government employee. She is being held on a $7,500 bond and is scheduled to appear in
court on May 22, 2014.

A Stigler man who was in a hurry to get to the bank after he got off
work on March 14, instead ended up behind bars when police found
drugs in his vehicle.
According to the affidavit, a Haskell County deputy was patrol in
Whitefield, when he saw a car speeding down the road. He initiated a
traffic stop at Highway 2 and Lee Street.
He made contact with the driver, 20-year-old Brad Nelson, and
asked him why he was in such a hurry.
Nelson told the deputy that he had just left work, and he was in a
hurry to get to the bank.
While talking to Nelson, the deputy noticed that his eyes were glassy
and his movements were slow. He asked Nelson if he had anything illegal in the car and Nelson said no. The deputy asked if he could search the vehicle, and Nelson said yes.
When the deputy searched the car, he found a small baggie of a green leafy substance in the
door panel. He asked Nelson if he had anything else illegal that he needed to know about, but
Nelson denied the presence of any other contraband items.
Nelson allegedly admitted that the had smoked marijuana “about 45 minutes ago.”
The deputy placed Nelson under arrest. Nelson told him that he had another bag of marijuana in his coat pocket, and told the deputy that he didn’t want another charge for bringing
contraband into a jail.
The deputy also found a marijuana cigarette in the car’s ashtray.
Nelson is being charged with possession of a controlled dangerous substance. He was released on a $1,500 bond and is scheduled to appear in court on April 1, 2014.

A crazed Haworth man was arrested after neighbors complained that he had been causing a disturbance in a Millerton neighborhood for quite some time; one woman had finally had enough of it and called police on March 13.
When a McCurtain County deputy and Valliant officer arrived at the residence of the reporting party, she told them
that Haworth man Shane Lee Carden, 32, had walked by her
house and started and yelling at her. She said he called her
derogatory names and threatened to kill her, scaring her
children.
She also said that Carden was carrying a big stick during
the altercation. The victim’s daughter told police that Carden
had told her mom he was going to do things to her, and that
he had scared her.
The victim explained that Carden had been making a ruckus in the neighborhood for the last six months. She alleged that Carden would regularly walk
up and down the road all hours of night and day, yelling, cussing and looking in residents’ vehicles. She said that she and many of her neighbors were scared to go outside of their homes
and let their kids play outside due to Carden.
A witness told police that she also heard Carden threaten the victim.
Police made contact with Carden. He told them that he had problems with his ears, dating back to 2007 when the doctors put something in them. He said he could hear things “all
over” and that he wouldn’t have a problem with his neighbors if they would just stay off of
their cellphones.
Police placed him under arrest, and on the way to jail, Carden allegedly told them that he
just needed his morphine patches and his other pills to make the pain go away. He explained
that his back and ears always hurt, but whenever he gets his pills, they are always gone the
next morning but he doesn’t know what happens to them.
At the jail, Carden told police that he sometimes doesn’t remember what he does, and he
asked them if they could get him some help.
Carden was released on a $2,500 bond and plead guilty to the charged of two counts of
stalking and disturbing the peace.

Language is needed to clarify the intent of the right to bear
arms in the Oklahoma Constitution, according to state Rep. Dan
Fisher.
“It’s obvious that Oklahoma’s Founding Fathers when drafting
the state constitution considered self-defense the primary reason citizens have the right to bear arms,” Fisher said. “Unfortunately, Oklahoma courts have sometimes interpreted the state
constitution in ways that go against that intent. Concerned citizens feel it is necessary to place new language into the state constitution to clarify the right, to
correct past misinterpretations by Oklahoma courts and to prevent similar misinterpretations
from occurring in the future.”
Written in 1907, the Oklahoma Constitution, Article II, Section 26, reads:
“The right of a citizen to keep and bear arms in defense of his home, person, or property, or in
aid of the civil power, when thereunto legally summoned, shall never be prohibited; but nothing herein contained shall prevent the Legislature from regulating the carrying of weapons.”
House Joint Resolution 1026, by Fisher and Sen. Greg Treat, would allow voters to change
Section 26 to specify “handguns, rifles, shotguns, knives, nonlethal defensive weapons and
other arms in common use, as well as ammunition and the components of arms and ammunition” and add “self-defense” and “lawful hunting and recreation” in order to ensure that courts
have less latitude in interpreting the language.
The constitutional amendment would also add two subsections to Section 26. The first would
clarify that the state could prevent convicted felons and the mentally ill from the possession
of arms. The second would prohibit registration or special taxation on arms and ammunition.
