A Spiro man is in custody after authorities say he tried to kill a woman
Jan. 21.
Around 8:40 p.m. that day, the LeFlore County Sheriff’s Department
received a report of a structure fire at
the 23000 block of Stewart Loop. A
couple of minutes later, Panama Officer Andy Bevil came on the scene and
saw a man and woman unconscious
in the front yard, with the house being on fire.
The man was identified as Elec Cusick, 39. The woman had blood on her
face and leg and burns all over her
body. There were also blood drops on
the porch leading from the front door to the yard, as well as blood
smeared across the refrigerator in the house.
The next day, officers, acting on a search warrant, found a bloody
knife in the kitchen and a broken 2x2 piece of wood covered in blood.
The story gets even stranger, however, once police started interviewing neighbors.
One neighbor said Cusick came over to her home and grabbed the
woman by her arm, dragging her back to the residence. The same
neighbor said she later looked outside to see Cusick standing over
the woman while she was on the ground of the driveway.
Doctors in Tulsa realized the woman had burns over 30-40 percent
of her body, and she had a V-shaped wound on the top of her head.
She had skull and facial fractures, multiple cuts and third degree
burns. How she got that way, though, was a shock to police.
Just before he left the hospital, Cusick said he was trying to keep
the woman from leaving, so he beat her with the piece of wood, breaking the wood into pieces. He also said he used the knife to cut her leg
open behind her knee so she couldn’t get up and leave the scene.
Cusick was arrested Feb. 1 on felony assault charges. He has a preliminary hearing set for 9 a.m. April 11.

A Poteau man’s marijuana trip landed him in trouble with local police on
Feb. 14.
Around 10:30 p.m. Feb. 3, patrolman Brad Cook spoke with a woman
at the police department about stolen
property from her vehicle.
The woman said someone took
things from her car while she was buying groceries at Walmart. A Walmart
supervisor helped Cook find video
surveillance of the area, which showed
a man walking around the parking lot
and trying to open doors. The man,
later identified as Shawn Martin, 23,
walked up to the woman’s car, opened a back door and took things
from the backseat.
The man walked the items back to a white GMC truck, allowing
police to get partial tag information.
Around 1:20 a.m. the next day, dispatch told police about a disturbance at a residence in the city limits. When Cook arrived, he saw
the truck in the surveillance video parked outside, which had tags
matching the one on tape. Cook told Martin to get out of the car.
Martin said he had a pipe and bong in his possession, according to
the affidavit.
Cook recovered the stolen goods, which were in Martin’s car. Also,
he found a bag with marijuana and two small bags with methamphetamine.
The homeowner gave consent to search her home, which turned up
the bong and a marijuana grinder. In an interview, Martin admitted
stealing from the car at Walmart and also said he stole from a car
at the Choctaw Travel Plaza, as well as a red cellphone and charger
from another car at Walmart.
Martin remains in custody. He has court set for 1:30 p.m. Feb. 22.

Many burglars are known for their array of disguises.
One burglar in Slidell, La. apparently forgot his and improvised. Surveillance video shows the 23-year-old suspect used a bucket when he robbed his former employer,
Kenney’s Seafood. The bucket seemed to hinder him a
little. The suspect had to tilt up the bucket every so often
to catch a glimpse of his surroundings. It turns out his
disguise was a bad idea. Police were able to identify and
arrest the suspect at his home.
A teenage girl and her friend are accused of drugging
her parents so they could use the Internet past curfew
time. “[The parents] woke up about 1 a.m. They had
hangover-like symptoms, they felt really groggy, had a
headache, went back to sleep. They felt the same way the
next morning,” said Lt. Lon Milka with the Rocklin Police
Department. The parents picked up a drug test kit that
some parents buy to check on their children. But they
used it on themselves. They discovered the milkshakes
the two girls had given them were drugged with sleep
medicine. The girls gave chocolate to dad and vanilla to
mom. The parents’ rule was no Internet access after 10
p.m. But with the parents in dreamland, the girls had
free rein. The girls are underage, so they won’t be facing
prison time. The case is being handled through the juvenile courts.
No one can say San Bernardino’s police chief is afraid
to “tackle” crime in the city. Chief Rob Handy was in civilian clothes Wednesday when he was alerted to a suspicious man trying to sell power tools outside a restaurant.
When the man saw a patrol car nearby, he took off on
foot. The chief ran him down and tackled him. During
the pursuit, a gun fell out of the suspect’s waistband. The
suspect was arrested on suspicion of being a felon in possession of a handgun.
A bizarre brawl involving a clown and a Milwaukee
police offi cer was caught on tape. Cellphone video shot
by witness Mitch Cooper shows the clown attacking a police offi cer. “The clown was resisting so the cop needed to
do what he needed to do to make sure he was safe,” said
Cooper who happened to be driving by. “It was funny
to witness, probably not so fun for the clown, but as a
spectator it was pretty entertaining.” According to a report, police had received several complaints prior to the
brawl that the clown had been chasing cars with a squirt
gun. The clown is a well-known local activist who is often spotted protesting outside government buildings. He
was arrested for disorderly conduct and resisting arrest.

A Latimer County man was sentenced
Feb. 7 to almost three years in federal
prison.
Arthur David Upton, 51, of Wilburton,
was sentenced to 34 months imprisonment, followed by 3 years of supervised
release for being a Felon in Possession
of Explosives.
Charges arose from an investigation
by the Pushmataha County Sheriff’s
Department and the Bureau of Alcohol
Tobacco and Firearms. The defendant
was indicted in August, 2012 and pled
guilty in September, 2012.
The indictment alleged that on or
about July 17, 2012, Upton, who was not a licensee or permittee, did
knowingly distribute explosive materials to any person other than a
licensee or permittee.
Upton will remain in the custody of the United States Marshal
Service, pending transportation to the designated federal prison at
which he will serve his non-parolable sentence.

A Hartshorne man’s desire to do
his job the easy way culminated in
a trip to county lockup for felony
charges Feb. 13.
Just before 9 p.m. that day, Pittsburg County Deputy Daniel McHenry
was dispatched to Dow after hearing
a report about a man spraying gas
around a house to set it on fire. While
McHenry was en route, the house
caught fire, so an officer from Haileyville went to the scene and caught
Ritchie Wansick, 45.
Wansick had a pressure sprayer
with two gallons left inside at the
time he was caught, as well as several lighters in his pocket. The
property owner said she hired Wansick to tear the building down
but not burn it. She said Wansick could have the lumber from the
property as payment.
Wansick said he spoke with the Haileyville police chief, who told
him it would be okay to burn the house down. He also said he called
the Hartshorne Fire Department to inform them of a controlled
burn.
Wansick was then arrested for second-degree arson and transported to the jail. While there, he showed McHenry text messages
between him and the police chief, which he believed gave him permission. However, McHenry said the text messages don’t indicate
the chief allowed the burn.
Wansick posted a $10,000 bond Feb. 15 and is not allowed to have
contact with the property owner, court records show. He has a previous conviction of endeavoring to manufacture methamphetamine,
receiving a 10-year suspended prison sentence.
He will next appear in court at 9 a.m. Feb. 22.

found dead inside his home at

A McAlester ex-con faces new felony charges after police
searched her house Jan. 25.
Just before 4 p.m. that day, District 18 Drug Task Force Investigator Walker Stewart said he received a call from Pittsburg
County Sheriff Joel Kerns, who said U.S. Marshals executed a
search warrant at the 400 block of West Ashland.
In the house, officers saw a glass pie plate with methamphetamine on it, a straw, two Ziploc bags with clear rocks and digital
scales. Stewart executed his own warrant and found the narcotics
in the house as well. Pittsburg County Deputy Tommy Lyons said
Debra Brown, 45, was at the house at the time.
Brown had a large silver spoon with residue, several pocket
scales, an aluminum plate with methamphetamine, a plastic
McDonald’s plate with razor cuts, a metal canister with a bag of
crystal meth and a bag of powder meth, two iPhones and a black briefcase with a bunch of
papers. Also, officers found a sawed-off shotgun, which, as Brown is a convicted felon, she
couldn’t legally have.
On Oct. 26, 2011, Brown was convicted of possession of a controlled substance in Oklahoma County. She received a five-year deferred sentence, records show.
Because of this, she faces between four years to life in prison for her newest charge.
Brown is in custody on a $100,000 bond. She received a court-appointed attorney Jan. 29
and has a court date set for 1 p.m. March 25.

Former Pittsburg County Special Judge William Layden Jr.
agreed Jan. 24 to a deferred prosecution to avoid a trial for his
part in a drug court embezzlement scheme, Attorney General
Scott Pruitt said.
Layden, 62, was indicted in October 2011 by the Attorney General’s Multicounty Grand Jury on a charge of conspiracy to defraud the state, after he interfered with a joint investigation into
the Pittsburg County Drug Court. The drug court coordinator,
Angela Marcum, was indicted in June 2011 on charges of embezzlement and destroying records. She is awaiting trial.
As part of his agreement, Layden agreed to pay more than
$4,700 in restitution to the State Auditor and Inspector’s Office
to cover one-third of the cost of an audit by the agency. He also
agreed not seek public or judicial office and not violate any laws.
In his affidavit, Layden said he took steps to protect Marcum that he “should not have
taken,” which hampered investigations by the Oklahoma Multicounty Grand Jury, the state
Auditor’s Office and the OSBI.
“The evidence I have seen makes me believe the State can prove Ms. Marcum did embezzle
funds … and that she used me in an effort to deflect attention to drug court participants and
away from herself,” Layden wrote.

Under cover drug agents defuse a mini meth lab found inside a
porta-potty in the middle of a golf course in Purcell.
Staffers noticed strange sports drink bottles with chemicals inside
the porta-potty and called police.
Officers arrived and soon realized someone had been inside making
meth using the “shake and bake” method.
Three bottles were found, two of them exploded before detectives
arrived.
Agents were able to neutralize the third one without the harmful
chemicals erupting.
“If someone would have been in the porta-pot when it happened
they might have gotten hurt by the flying plastic and the chemicals,”
Purcell Dt. Cpl. Scott Stephens said.
Investigators said they have a lead on one suspect but said they believe others could be
involved.
The inside of the unit was damaged but agents were able to submit latent fingerprints to a
crime lab.

A Eufaula man was taken into custody after his wife called police when he
allegedly threatened to kill her.
Wade Jennings, 43, was charged Feb.
4 with possession of a firearm after a
former felony conviction in McIntosh
County District Court.
According to the police affidavit, Eufaula Police Officers Torix and Bean
arrived at the Eufaula Inn Motel soon
after the report came in to the station
just after 2:00 a.m. on Feb. 3 about the
threat. As the officers got out of their
cars and walked up to the motel, they spotted Jennings walking toward them. He began shouting belligerently, “She stole my
f**king car! Go f**king arrest her!”
Due to the nature of the call and Jennings’ actions, Torix covered Bean with his duty weapon as he cuffed Jennings for their
safety. Torix told Jennings he was just being detained until they
could figure out what was going on.
Jennings told the officers he and his wife had gotten into a fight
and she stole his car. Torix asked him if he had a gun, but he replied, “No! I’m a felon, I can’t have any guns!”
Jennings granted permission to search the motel room for a
gun. When they searched the room the first time, they didn’t find
a weapon, but another check revealed a silver Smith & Wesson
revolver hidden under the air conditioning unit next to the front
door. It was fully loaded with six .657 hollow point rounds. When
Torix walked out of the room with the gun, Jennings went ballistic.
At the McIntosh County Jail, Jennings maintained he was
framed and asked for his lawyer. Bond was set at $20,000 and
he was ordered back to court May 16 for his preliminary hearing.

In this installment of Tips From
a Trooper, I’m going to talk about a
violation that we see every day. It
is something I am sure most of my
readers have done, many times, without giving it another thought. I
doubt if most have even considered it to be unsafe, much less illegal,
but it is. The violation is passing on the shoulder, and it happens all
the time.
The car ahead of you is stopped in the lane of traffic, and you see the
left turn signal on. Its not turning because of oncoming traffic, which
it must yield to before turning, so you just slide your vehicle over to
the right, onto the shoulder, or maybe even just the widened part of
the road where the intersection is, and pass right by them. Maybe
you slowed down a little, just to be safe, or maybe not. You are in a
hurry, and don’t want to slow down to wait for traffic to clear. Doesn’t
seem like a big deal does it? Well, passing on the shoulder is illegal,
and can be a very dangerous situation!
The Statute governing this scenario is actually in the section that
states when passing on the right is permitted...it gives a few examples,
one of which is when a vehicle is preparing to make a left hand turn.
Sounds like its covered and should be legal, right? The last sentence
of this Statute is where you find the restriction for passing on the
shoulder.
It states:
The driver of a vehicle may overtake and pass another
vehicle upon the right only under conditions permitting such
movement in safety. In no event shall such movement be made
by driving off the pavement or main traveled portion of the
roadway.
Statute also defines roadway for us: That portion of highway
improved, designed or ordinarily used for vehicular travel, exclusive
of the shoulder.
The reason for this Statute is simple, and for this exact scenario...
not only is the vehicle in front of you turning left, but the oncoming
vehicle is also going to turn left, and visibility of your vehicle is
blocked by the stopped one, which makes a blind spot, and the
potential for the oncoming vehicle to turn left in front of you, just as
you are passing the other vehicle! We work accidents where this is the
causation all the time, and they can all be prevented by obeying this
law, and practicing some patience! How much time do you think you
actually save when doing this, anyway? Next time you see someone
do it, watch and see if you don’t catch them at the next traffic light...
they really didn’t save anything, and a couple of seconds aren’t worth
risking an accident and a life.
