4 | AUGUST 2019 MCCURTAIN COUNTY Presumed Innocent Until Proven Guilty
A South Carolina man was caught rubbing buttered toast all over his neighbor’s SUV
window. Seems like a foolproof plan, how did he get caught? According to MSN, He
just dropped the toast a few feet away from the car and made his departure, causing
a nearby woman to notice and call the police. The police charged the now hungry man
with “malicious damage to property” and estimated the cost of damage to be about $1.
What’s the hottest you’ve ever been? Temperature-wise of course, because if it was
in physical terms, we all know we were the hottest at our 5th grade, bowl-cut, chubs
stage. But really, to what extent would you go to cool off?
Hopefully not so far you’d get arrested, but this is exactly what a group of four young
men in Germany did. On a hot day, they decided to make their own pool in a car.
In a BMW no less. A policeman noticed a very strange convertible driving down the
road. Upon closer viewing, it appeared that the bathing-suit clad men were splashing
around in the water-filled car, clearly intoxicated. Though there was no law against driving around with a pool in someone’s car, they were probably charged for driving without
a permit. Talk about hot water.
What do you guys think about sausage? I suppose it’s better than a hot dog, which
in turn is better than bologna (which is basically giant hot dog slices?). And no matter
what, it has to be better than Lunchables *shudder*.
No matter your opinion, sausage was a huge disappointment for this Phoenix man.
He attempted to rob two large businesses, first an Ace Hardware and then a Safeway.
He put his hand under his shirt to look like a gun, but the cashier was not fooled and
calmly said “no” to his request for money. Equally unsuccessful was his attempt to rob
a Safeway, which resulted in him being escorted out of the building. He waited a few
minutes before returning into the store to snag a small breakfast sausage and was
therefore charged with shoplifting. I guess all that failing worked up an appetite.
Sometimes people don’t want their babies. Throughout history, these people have
found convenient ways to get rid of them. In the middle ages, a popular solution was
to leave a swaddled infant on the doorstep of a misfortunate new parent. Worse for the
child, another option was an orphanage. In later times, parents could even put their kid
in the circus for life. The last one, I’m actually jealous of.
It might not have been this Florida woman’s goal to give away her child, but that’s
sure what it looked like. She had gone shopping at Dillard’s, and tried to shoplift $260
worth of clothing using her baby stroller. When a police officer followed her out to her
car, she flipped out and eventually threw her baby in its little carseat at him. The baby
was not injured. The shoplifter received three charges, including “resisting a police officer without violence”. Um. What would be violent, throwing her entire family?

blame it on the wife
Broken Bow man Valee Edward Percy Jr.,
47, was put behind bars after police caught
him driving a stolen car around town in the
early morning hours of July 9.
According to the affidavit, a Broken Bow officer saw a car pull off the roadway on Silvey
Road around 1:36 a.m. As he drove past the
vehicle, he noticed that it had an Arkansas
license plate. He asked dispatch to check the
license number – dispatch advised that the
vehicle had been reported stolen out of Arkansas.
The officer stopped the vehicle at Second
and Lincoln Streets and made contact with
the driver, identified as Percy. He told Percy to
turn off the car and throw the keys out of the car. He also told the driver and
passenger to put their hands out of the windows.
Other officers arrived as backup, and Percy was placed in handcuffs. The
passenger was also put in handcuffs while officers investigated the situation.
While checking the man’s information, an officer was advised that Percy
was driving around with a suspended driver’s license. When an officer asked
where the vehicle had come from, Percy told police that his wife had bought
the vehicle from her son.
The passenger was released at the scene. Percy was transported to jail.
Percy is being charged with possession of stolen vehicle after former conviction of a felony and driving with license canceled/suspended/revoked. His
bond was set at $15,000, and he is scheduled to appear in court on August
13, 2019.

An Atoka man was taken into custody after he was
found walking down a street high on meth and carrying
a rifle.
Brandon L. Gerard, 36, was charged July 1 with misdemeanor public intoxication and carrying firearm while
under the influence, in Atoka County District Court.
Reports state Atoka Police received a call that morning
of a man walking in town with a rifle. An officer found the
man, identified as Gerard, walking along W. 13th Street
carrying a rifle. When asked about the weapon, Gerard
said he was waiting to kill another man. He added that if
the officer took the rifle away from him, he would just go
and get another one.
Obviously intoxicated, Gerard allegedly admitted to earlier taking pills and
meth.
Turns out Gerard was a former deputy at the Atoka County Sheriff’s Department, but reportedly hasn’t been employed by the department for many years.
Gerard pleaded guilty and was sentenced to six months deferred until January 2020, pay $100 fine, court costs of $276.50, and $50 VCA. Court records
show Gerard entered rehab and was ordered back to court within 10 days of
his release.

those shoes
A 38-year-old Durant man allegedly stole $25K worth
of equipment and a pair of shoes from Southeastern’s
baseball field on May 27.
Bobby Joe Waller told police they had the wrong guy.
According to the police report, a Southeastern officer was advised around 10:38 a.m. that a theft had
occurred at the field. He went to investigate and noticed that someone had cut locks on four gates to the
baseball complex. Groundskeeping tools, a John Deere
3-wheeled rake, and a turf mower, valued at a combined
$25K, were missing.
The officer followed some tracks to a gate at the south
end of the complex. He drove around the area until he
saw the orange turf mower in the 1800 block of N. First.
A man was sitting on the mower. When he saw the officer, he jumped off the mower
and stopped near a green tarp. It appeared as though he was considering covering
the mower with the tarp.
The man then walked into the tree line and refused to obey the officer’s command
to stop. He instead said, “F--- you, I found that stuff here.” He told the officer he had
been hog hunting, but he wasn’t dressed for the activity and they were still in the city
limits of Durant.
The man took off into the woods. Officers called off the search a while later.
During the investigation, officers found the stolen items hidden in the tree line. Everything was accounted for except a pair of shoes that was issued to student-athletes.
One of the officers said the description of the suspect matched the description of
Waller.
The next night, Waller was arrested for public intoxication while looking through
some vehicles at an apartment complex. He was wearing blue and white shoes that
matched those issued to Southeastern athletes.
The investigating officer went to the jail and identified Waller as the suspect. Waller
said he wasn’t the man the officer had seen. When the officer asked him where he had
gotten the shoes, the man said he couldn’t remember.
Waller is being charged with grand larceny after former conviction of a felony. His
bond was set at $5,000, and he is scheduled to appear in court on July 24, 2019.

Presumed Innocent Until Proven Guilty 23 | AUGUST 2019 CHOCTAW COUNTY
The OSBI is offering a $5,000 reward for information that can help
agents solve the 1977 disappearance of Ronnie Odell Davis. Davis
was last seen at his horse corral
near Swink, Okla., on August 24,
1977. Neither he nor his 1975 Ford
XLT have been located since. The
Choctaw County District Attorney asked the OSBI to assist with the investigation on August 30, 1977. Davis is believed to be the victim of foul play.
Over the course of the 42-year investigation, numerous interviews and
investigative leads have been attempted by various agents in an effort to
find the victim and determine who is responsible for his death. At this time,
investigators are hopeful the passage of time and the potential of receiving
a reward will be beneficial in generating new leads.
If you know anything about Davis’ disappearance or where his remains
are located, please contact the OSBI at (800) 522-8017 or tips@osbi.
