A Bixby man, on trial for murdering his stepfather,
has been found guilty by a Rogers County jury. A
sentence of life without parole was recommended
on the verdict.
33-year-old Kevin Foster was charged December
4, 2018, for murder first degree, arson first degree,
desecration of corpse, possession of firearm during commission of a felony, trespassing after being
forbidden, and injury to cemetery/gravestone/tomb,
in Rogers County District Court.
Reports state firefighters called law enforcement
to the scene of a house fire after finding the body
on November 15, 2018, while battling the blaze.
The man appeared to have been killed by a wound
on the abdomen. An investigator with the medical
examiner’s office said it appeared the man was already dead with the fire started.
The fire seemed to have been started by someone, due to the presence of accelerants at the scene.
During the investigation, Kevin Foster was arrested as a prime suspect.
Foster and the victim had been involved in a dispute involving some cemetery
plots where the victim’s wife was buried, and where he would be buried when he
died.
According to reports, Foster filed sham legal documents to Tulsa County allegedly that he owned the plots. He also removed a headstone that displayed the
victim’s name and replaced it with one that did not show the man’s name.
During the investigation, officers went to the Claremore cemetery where the
plots were. The headstone that displayed the victim’s name had been kicked over.
A witness said a man who matched Foster’s description was at the cemetery
for approximately 30 minutes before leaving in a hurry.
While looking into the man’s murder, investigators were advised that the victim
had won a major victory in a civil suit against Foster a week before his death.
Foster denied being in Claremore the day the man allegedly died, despite surveillance footage from a gas station that proved otherwise.
Formal sentencing is set for February 13, 2020.

Leonard Ray Richardson, Jr., 36, of Guthrie, was charged November 19 with endangering others while eluding/attempting to elude, and driving under suspension, in Mayes County District Court. Jimmie Beth Falling, 27, of Adair, was charged November 25 with escape from arrest or detention, and obstructing an officer, in Mayes County District Court. According to the Mayes County Sheriff’s Office, on October 15, Mayes County deputies attempted to stop a truck in the early morning hours of that day. The truck failed to yield, which lead the officers on a dangerous pursuit all over Mayes County. GRDA, Pryor, Chouteau and Locust Grove Police Departments were requested for assistance. After stop sticks were deployed twice, the truck finally came to a stop. The occupants ran into the woods but the female, identified as Falling, was apprehended. The male, identified as Richardson, got away. While deputies were busy on the scene, Falling was able to escape back into the woods. According to the booking report, Richardson was apprehended on November 20, and Falling on November 18. Richardson’s bond was set at $100,000 and was remanded to the Mayes County jail until bond could be posted. Staff at the Pinnacle Bank branch in Lincoln reported the incident to police. The Lincoln Journal Star reports that bank employees say the man was adamant that the bill was real despite tellers’ attempts to convince him otherwise. The man eventually left with the bill, but without a new account. Police are reviewing surveillance video to try to identify the man. Police say they want to check on his welfare and make sure he was not the victim of a crime. The largest denomination note ever issued for public circulation was the $10,000 bill. A Florida judge got to see more evidence than he expected when an accused woman flashed her breasts in court. Susan Surrette, 54, was arrested for disorderly intoxication in Fort Lauderdale. She appeared in a Broward County bond court via a video feed, NBC Miami reports. At one point during the hearing, Judge John Hurley asked Surrette what she did for a living. She replied that she worked as an escort and porn star under the name “Kayla Kupcakes.” During the hearing, Surrette alleged she was the victim of police brutality and lifted up her shirt to offer proof, according to WPTV. After her visual demonstration, Surrette told the judge she has a mental condition. Her attorney then told the judge: “She’s somebody that needs help. She’s not going to get the help that she needs at the jail,” according to WPLG. The judge ordered Surrette to pay $100 bond and undergo a mental evaluation. Under the name Kayla Kupcakes, Surrette has appeared in numerous adult films since 1998, including “Private Stuffers 1,” “Sexcretaries” and “Mature Thunder Buns 1.” When police in Largo, Florida, arrested Jeffrey Forrest Poole on charges of violently resisting a police officer, the authorities made sure to list things like his age, weight and address in his arrest report. Officers also included an alias that Poole has allegedly used in the past ― and it’s pretty awesome, as well as NSFW. Police were called to the 37-year-old suspect’s home on a reported domestic disturbance. When the officer arrived, according to the criminal complaint, Poole exited his home and said, “I will beat every cop’s ass!” Then Poole “raised his right fist and began to extend it towards my face in an attempt to strike me,” the arresting officer wrote, according to The Smoking Gun. Since Poole was arrested and taken to the Pinellas County Jail, it is highly unlikely he made good on his ass-kicking promise. Poole was charged with assaulting a police officer and violently resisting a police officer. What makes this case interesting beyond Pinellas County is one tiny detail: The criminal alias Poole has previously used, one “Dickface Johnson.” That name showed up because Poole was either asked if he had any alias or a record on file under that name, according to brobible.com. You know when you’re in an art gallery and you decide to steal one of the paintings off the wall and then you can’t find a way to jam it into your sweatshirt because it’s a painting and large rectangular paintings don’t belong inside sweatshirts? Hate it when that happens! Well, this art thief ran into a similar problem. Luckily, the piece was recovered by gallery staff before the suspect could escape with it. However, the would-be thief is still on the lam. Police in the U.K. have released surveillance video in the hopes that viewers will be able to help locate him. Reports state Ash Express was burglarized on two separate occasions. During the burglaries, the suspects took cigarettes, cigars, and beef jerky. Nowata deputies and police officers worked together to serve a search warrant relating to the burglaries on the morning on October 25. While executing the search warrant, law enforcement arrested William Andrew Gross, Kaitlyn M. Keeler and William Robert Powell for their involvement in the burglaries. Quinton Isaiah Ballard was also arrested. He was initially able to escape police custody for a short time, but he was eventually apprehended by officers. In addition to the burglary charges, Ballard was also booked with a complaint of escape from arrest charge. Gross was arrested for possession of stolen property and conspiracy to commit a felony. According to the police report, a Delaware County deputy and District Attorney investigator were dispatched to investigate a stolen vehicle at approximately 12:47 p.m. The victims had reported their vehicle stolen earlier that day and they had just spotted Kenneth Ray Castillo being the wheel of the stolen truck. The victims followed the vehicle down Highway 10 by the Grand Lake Casino. When the officers met up with the victims on 250 Road just east of Highway 10, they said Castillo had left the stolen vehicle and walked toward a 5th wheel travel trailer. The officers looked at the trailer and saw two people getting into a nearby car. They approached the car and told the occupants to get out. The driver exited the vehicle and said the passenger had just asked him for a ride. The investigator looked in the car and saw Castillo slouched down in the passenger’s seat. He had latex gloves on his hands. The officers told the man several times to get out of the car, but he refused. They finally removed him from the vehicle and checked him for weapons. One of the victims said Castillo had been driving him around that day in his own vehicle. At some point Castillo took off in the truck without the victim’s permission. The vehicle was then reported stolen. Castillo admitted to driving the victim around and said he kept the vehicle longer than he should have, but he only did that because he ran out of gas. He said he tried to call the victims several times to let them know, but they never answered the phone. Castillo is being charged with unauthorized use of a felony after former conviction of a felony. John Theodore Linthicum, 50, was booked into the Craig County Jail on one count each of felony embezzlement of property and larceny of domestic animals. He was released on October 30 after posting a $500,000 bond. The charges state Linthicum, also known as Teddy Linthicum, committed the Felony Embezzlement on or between Jan. 1, 2017 and Oct. 14, 2019, by fraudulently appropriating $429,000 from Troy Jansonius and Gimmie Jo Jansonius. The crime is punishable by incarceration of eight years in the state penitentiary, and a fine not to exceed $10,000 plus restitution. The second charge, Larceny of Domestic Animals, took place during the same time period, and states Lithicum wrongfully took a cow that belonged to the Jansonius without consent with the intent to deprive them of the property permanently. The crime carries a punishment of imprisonment for three to 10 years. In the probable cause affidavit, filed by ODAFF Special Agent Dusty Goforth, states the charge relates to 128 head of cattle Gimmie Jo Jansonius, Troy Jansonius and Elwynn Jansonius shipped to Litnthicum in 2014 to a property in Welch. At that time, Goforth said the Jansoniuses arranged for Linthicum to breed half of the cattle with embryos, and the remaining cattle were to be bred by bulls. The embryo calves were to be purchased by Linthicum while the bull bred calves were to be marketed by the Jansoniuses at a sale barn. On Jan. 29, 2018, the family obtained a court order to pick up their cattle. At that time, Goforth said Harold Post, the receiver in Linthicum’s bankruptcy case, reported Linthicum had in his possession 46 head of the Jansonius cattle along with eight head of calves. The family provided Goforth and Winfrey with a list of 85 missing cows and two year’s worth of calf crops. The total value of the missing animals, based upon average market price was $429,000. At least one of those cows were found during the investigation at Flying Cow Genetics, among 90 head of cows Lithincum traded to Tony Small for a vet services debt. “This is a joint operation between the Craig County Sheriff’s Office and the Oklahoma Department of Agriculture, Fish and Forestry,” Winfrey said. “It remains ongoing and under investigation.” This is Linthicum’s sixth arrest. The naked man had also tried to break into a home. At the time of the call, the suspect, later identified as 43-year-old Douglas Eugene Fidler, was sitting on top of the reporting party’s car. When the deputy arrived on scene, the reporting party told him that the suspect was hiding by his car. The deputy walked to the vehicle and saw Fidler, crouched down with everything exposed – he did have a flannel shirt on his top half, though! The deputy told him to come out of the bushes. Fidler obeyed, and the deputy gave him some shorts to wear. While they were speaking, Fidler quietly said, “I was talking to her.” The deputy asked him who he was talking about. Fidler then said, “I didn’t get close. I stayed by the street.” He was then placed under arrest. The deputy spoke to the reporting party and asked him what had happened. The man replied, “Me and my daughter were in the house. My daughter told me there was a man outside, then asked me why he didn’t have on pants. I looked outside and saw the guy standing by my porch naked. I went outside and told him to leave. He walked back by my car, so I called the cops.” Fidler is being charged with indecent exposure. According to the affidavit, a Miami officer was dispatched to Iverness Court to investigate multiple reports of a suspicious vehicle in the area at approximately 9:15 p.m. When he arrived, he saw the suspect vehicle traveling slowly, headed east. As the officer pulled up behind the vehicle, the driver, later identified as Floyd Lee Miller, pulled to the curb without signaling. The officer watched, and Miller just sat there with his brake lights on. The officer then activated his lights and pulled in behind the vehicle so he could talk to the driver. Miller instead took off from the scene, headed east on 20th Avenue NE. Another officer drove into the lane to signal the driver to stop, but Miller instead just drove around him. Another officer set up a roadblock on 22nd Avenue NE and Oak Lane, but Miller drove past it. The chase continued onto North Main. Miller briefly exited city limits, but then drove back into Miami on P Street NW. An officer set up some stop strips in the road at P Street NW and 22nd Avenue NW. Miller drove right over them. The strips deflated the front tires of Miller’s car. The vehicle started to slow, but the driver still wasn’t stopping. Quapaw Tribal marshals arrived on scene to assist and pointed their pistols at Miller. The vehicle finally came to a stop and officers took the man out of the car. Miller seemed agitated when officers asked him why he ran. While conducting inventory of the vehicle, police found a backpack containing two smoking pipes with white and burnt residue. The pipes later tested positive for meth. Miller later told the officer that he ran because he didn’t want to go to jail. He said he thought he had warrants for his arrest, but he actually didn’t. Miller is being charged with two counts of running a roadblock after former conviction of a felony and unlawful possession of drug paraphernalia.
