A Stillwater ex-con faces new
felony drug charges following a
traffic stop Dec. 7.
Around 1:30 p.m. that day,
Stillwater police officer Royce
Stephens was patrolling the
intersection of 3rd and Main Streets
when he saw a black Suzuki Vitara
make an improper turn. He initiated
a stop at 10th Street and, when
he got out of his car, was nearly
overwhelmed by the smell of burnt
marijuana.
The driver, Ella Dickens, 49, said
she did not have her driver’s license with her. Dickens also had
strong weed breath, which prompted a search of the vehicle,
according to the affidavit.
Stephens found a partially destroyed marijuana cigar beside
Dickens’ seat. Another officer found a bag of marijuana in
Dickens’ pants pocket. To make matters worse for Dickens, the
officers found out her license was suspended.
Upon her arrival at the Stillwater Police Department, Dickens
told Stephens “check my change pocket”. The officer did so and
found a half-smoked marijuana cigar, he said.
A check of her criminal history at the jail revealed prior drug
convictions for possession of crack cocaine and marijuana. In July
2007, Dickens was arrested following a traffic stop for a broken
tail light and no insurance. A search of her vehicle at the time
turned up a marijuana pipe hidden in a cigarette box and a rock
of crack concealed in her sock, court records show. She received a
five-year deferred prison sentence.
Dickens was released from custody Dec. 8. She will next appear
in court at 1:45 p.m. Jan. 9.

George Ochoa executed
Oklahoma death row inmate George
Ochoa was executed Dec. 4 for the 1993
shooting deaths of a couple during a home
invasion.
Ochoa maintained until the end that
he was wrongfully convicted of fi rstdegree murder in the shooting deaths of
Francisco Morales, 38, and Maria Yanez,
35, on Oklahoma City’s south side.
The punishment came less than a
month after the state Pardon and Parole
Board rejected Ochoa’s request that it
recommend Gov. Mary Fallin reduce his death sentence to life in
prison.
Investigators say Morales was shot 12 times and Yanez 11 times in
their bedroom on July 12, 1993. Three of the couple’s children were
inside the house at the time of the shootings and later testifi ed at
trial.
Prosecutors said there was little evidence to suggest a motive for
the killing, but no doubt that Ochoa and his co-defendant, Osbaldo
Torres, 37, were responsible. Ochoa and Torres were stopped
by police near the crime scene and were described by police as
“sweating and nervous,” court records show.
Torres, a Mexican citizen, was also convicted of fi rst-degree
murder and sentenced to death in the shootings, but his sentence
was reduced by then-Gov. Brad Henry in 2004. Henry imposed a
sentence of life without parole after Mexican government offi cials
raised concerns that Torres was not given a chance to speak with the
Mexican consulate after being accused, as required by international
conventions.

A Perkins woman faces a felony charge
after reportedly crashing into her exboyfriend’s trailer Dec. 13.
Around 8:30 a.m. that day, Perkins
Deputy Chief Steve Hensley was
dispatched to the scene of a vehicle
hitting a trailer home. He saw a silver car
with the front end against the side of the
trailer. The car and trailer were severely
damaged, but the driver was nowhere
to be found. The front end of the car
was bent toward the windshield and the
trailer’s water lines were damaged, he
said.
Hensley then questioned the trailer’s owner, who said Tammy
Russell, 44, drove her car into his home. He said he and a relative
were asleep when they woke up to feel the trailer shaking twice. The
man said Russell is his ex-girlfriend who is “infatuated” with him,
and the other witness said he saw Russell leaving the scene after the
crash.
Russell, not thinking her act of rage through, called a wrecker
service to the trailer requesting that her car be towed to her house.
Hensley spoke to Russell using the wrecker driver’s phone and told
her to come to the police department for questioning. Russell said
her former lover “pushed her over the edge” so she drove her car into
his trailer. She also said he texted her threatening to use his pistol
on her.
At the police department, Russell revealed the source of her anger:
jealousy. She argued with the man about a blonde woman being at his
trailer and told him she would come over to “kick his ass”, prompting
his alleged threat. After he said that, Russell said she “lost it”, so she
dropped her kids off at school and then drove to the trailer, ramming
into it four times. She wanted the man to come out of the trailer so
she could kick his ass, she said. However, he never came out of the
trailer so she walked to her home and called the wrecker service.
Russell was charged with malicious injury to property. She posted
a $5,000 bond and has a court date set for 1:45 p.m. Jan. 8.

Two Tennessee would-be robbers tried to “disguise”
themselves by covering their face in black magic marker. That is never, ever a good reason to apply black anything to a white face.
Bad news: A Florida man was pulled over and arrested after the police searched his car and found
marijuana and drug paraphernalia. Good news: In
the process, the police found a bong that the man had
been looking everywhere for -- and thanked the cops
for their help.
If you’re anything like the woman in Sweden arrested for drunk driving, you may think you can get out of
the case by covering up one eye to avoid double vision,
as she claimed in court. Unfortunately, it won’t work
(neither the method nor the excuse).
There’s a reason that billboards don’t say, “Drink.
Drive. Go To Jail. Next time, get your 10-year-old son
to drive instead.” But one Tennessee man found out
the hard way that it might not be a great idea after the
car crashed (everyone is fi ne).
You gotta hand it to a Dallas man who tried to cash a
fake check for $360 billion. Why not?
When a 14-year-old Tampa Bay boy dialed the
wrong number, he quickly apologized, then offered to
sell the person on the other end of the line some drugs.
Unfortunately for him, that other person was a cop.
A Colorado man went to a video store and claimed
that as a part of the “age verifi cation unit” of the local
police department, it was his duty to confi scate DVDs
of pornography to ensure that all the actresses (and
actors, presumably) were over 18. As foolproof as this
plan was, he was arrested by the cops deployed from
the Creepster Verifi cation Unit. Apparently he had
never even heard of the Internet.
Since when was it a crime to try to resuscitate a longdead armadillo on the road? Who knows, but a drunk
Pittsburgh man who tried was arrested anyway.

Two managers at the Cushing Wal-Mart were
arrested Dec. 10 for allegedly stealing electronics
and other merchandise to sell on the streets.
Assistant manager Bobby Davis, 41, of Cushing,
was charged with knowingly concealing stolen
property unlawful possession of marijuana, and
possession of drug paraphernalia.
Support manager Jacob Estes, 25, also of
Cushing, was charged with knowingly concealing
stolen property.
Loss prevention had conducted an internal
investigation after they were tipped off by a
distributor that a man tried to sell him a movie
that had not been released for sale yet, according
to the police affidavit. When questioned, Davis
and Estes both admitted to taking items from the
store for some time. A search of their vehicles and
homes revealed DVDs, video games, computers
and tablets that had been taken from the store
worth more than $10,000.
At Davis’ home, officers also found marijuana.
Davis and Estes were taken to the Payne
County Jail and booked.

When I think of holidays, and
Christmas especially, I think of kids!
To me its all about the kids...seeing
their faces when they see that Santa has stopped by and dropped off
a lot of presents, watching them play during Christmas break, and
just getting to spend time with their family. So in that vein, I thought
I would talk about a law that is designed just for the kids, and that is
the Child Passenger Restraint Law! I’m going try and hit the major
points and put it in terms we can all understand.
First, the legal stuff; O.S. 47-11-1112 states:
Every driver, when transporting a child under six (6) years of age in
a motor vehicle operated on the roadways, streets, or highways of this
state, shall provide for the protection of said child by properly using
a child passenger restraint system. For purposes of this section and
Section 11-1113 of this title, “child passenger restraint system” means
an infant or child passenger restraint system which meets the federal
standards as set by 49 C.F.R., Section 571.213. (Look for something
on the package when purchasing that says it meets this standard!)
Children at least six (6) years of age but younger than thirteen (13)
years of age shall be protected by use of a child passenger restraint
system or a seat belt. Now, there are some drivers this does not apply
to; namely, the driver of a school bus, taxicab, moped, motorcycle, or
other vehicle not required to be equipped with safety belts, ambulance
or emergency vehicle, and the driver of a vehicle in which all seat
belts are in use. Also, someone who is transporting a child who for
medical reasons are unable to be placed in such devices, provided
there is written documentation from a physician of such medical
reason. It also doesn’t apply to the transportation of a child weighing
more than 40 pounds in the back seat can be wearing only a lap belt,
provided that the vehicle either wasn’t equipped with combination
lap/shoulder belts, or all of those combination belts are in use by
other children weighing more than 40 pounds.
Common sense says our children must be protected. The really
young ones have no choice in the matter, and it is up to us to keep
them safe, and buckle them in. I know some of the older ones can
unbuckle themselves, and do so often. If you start at an early age
with them, it will be second nature for them to stay buckled. And
finally, remember, you are the biggest influence on children, and they
WILL do as you do! So if you aren’t buckling up, they won’t want
to either! Be a positive influence, and lead by example. Thanks for

And now, from the Tales of Terrible Parenting That Could Have Ended Waaaaay Worse: A
31-year-old Broken Arrow man was arrested on
Dec. 6 after leaving his two children inside a car in
a bar parking lot while he went to drink. The kids
— aged 5 months (!) and 2 years — were luckily
okay, though the 2-year-old has health issues and
is currently awaiting surgery for a heart defect. The
slurring perp, Jason Daniel Murray, was booked
on charges of child abuse and neglect. And it gets
worse — per an arrest report, Murray refuted leaving the tots in the car, claiming “someone else must
have put the kids in the car while he was inside.” Denial ain’t just a river in
Egypt, dude.

Funk flunked Credit Card Theft 101
John Michael Funk, a 27-year-old Ohio man,
was jailed Nov. 28 after he allegedly tried to use a
stolen credit card in front of a police officer.
According to the Stark County Sheriff’s Office,
police responded to a call from Funk’s 60-year-old
mother stating that he had stolen her credit card
and used it to buy cartons of cigarettes at Main
Street Marathon, a local convenience store.
Investigators say while officers were at the store
investigating the report, Funk walked in and
attempted to use the same card, right in front of
police. He was apprehended around 10:30 p.m.
Funk was booked into the Stark County Jail and
charged with two counts of theft from an elderly
person and one count of receiving stolen property.
He was released as a non-violent offender.
This is not Fink’s first run-in with the law. He has been charged with 10 separate
offenses so far this year, according to court records.

other countries to get their kids... Sad. A majority of
these women were not FORCED to be anything. It
was a choice they made. Mandatory Birth control...
NOW! Women can be just as brutal and vicious as
any man, criminal thoughts go through every mind...
acting on them is the difference... following the law
or breaking the law. I do not feel any sympathy
towards anyone whose case I personally follow that
is convicted of violence or drug related. Burglary or
theft... I hope they get maximum sentences. Child
Abuse... Neglect... I hope they never get out... and I
do not even like kids... Same thing though... I hope
they NEVER get Out.

is a “mom” that is in prison. I feel sorry for the
children that were born to these women. I raise 2
that have a mother with issues and with me being
a step parent, the “real mom” really makes it hard
for me to teach these kids right from wrong! She’s
always encouraging them to make bad choices. i
think if You’ve ended up in prison, you’ve obviously
wronged your children in some way! I would also
like to add that the over crowding is possibly due

In the US, we have the most people in jail in the
world. In Oklahoma, there are more women in
jail than anywhere else in the US. Oklahoma ha
the most women locked away in the WORLD! The
court systems are harder on women in Oklahoma
than men, THEY WILL ADMIT IT. Release drug
offenders, get them help, show them how to live.
The director of the Oklahoma Department of
Corrections says the prison system is out of
space for female offenders.
The Tulsa World reports that DOC Director
Justin Jones following a Board of Corrections
meeting in Vinita that fewer women are being
released this year while more women are
being convicted and sent to prison.
He says the increase is due to some
convicts being required to serve 85 percent
of a sentence in addition to enhanced
punishments for others.
Jones says the department took in 1,198
female inmates last year and released 1,162.
He says the agency is projected to receive
1,242 women this year and expects to release 1,131.

Answer: The Bible does address the issue of
rape. As expected, when the Bible mentions the
crime of rape, it is depicted as a gross violation
of God’s design for the treatment of the human
body (Genesis 34). The Bible condemns rape
whenever it is mentioned. For example, there is a
particular passage in the laws given to the nation
of Israel before entering the Promised Land under
Joshua’s leadership. This passage (Deuteronomy
22:13-29) spoke directly against forcing a woman
into a sexual encounter against her will, or what
we know today as rape.
In the New Testament, rape is not mentioned
directly, but within the Jewish culture of its writers, rape would have been
considered as sexual immorality. As such, both Jesus and His followers (including
the apostle Paul) spoke against sexual immorality, even offering it as justifiable
grounds for divorce when a person actively committed sexual acts outside of the
bond of marriage (Matthew 5:32). This would not, however, apply to the victim
of rape, only the one who committed the act.
Further, the New Testament is clear that Christians are to obey the laws of their
governing authorities (Romans 13). Not only is rape morally wrong; it is also
wrong according to the laws of our governing authorities. As such, anyone who
would commit this crime should expect dire consequences, including arrest and
imprisonment.
To the victims of rape, much care and compassion must be offered. God’s Word
often speaks about helping those in need and in vulnerable situations. Christians
would do well to practice these teachings and model the love and compassion of
Christ by assisting victims of rape in any way possible.
To those who have committed rape, we must remember two things. First, people
are responsible for the sins they commit. Second, however, no one is beyond the
grace of God. Even in the lives of those who have committed the vilest of sins,
God can extend forgiveness to any who will repent and turn from their evil ways
(1 John 1:9). This does not remove the need for punishment according to the law,
but it can offer hope, even to those whose sins have made them outcasts in the
eyes of others.

A Guthrie woman received her
fourth DUI after almost crashing
into a police cruiser Dec. 17.
Logan County sheriff’s deputy
Kejuan Joseph said he was patrolling
in Guthrie when he saw a 2008
Pontiac Grand Prix coming at him
head on. He immediately initiated a
traffic stop and confronted Tuesday
Mayes, 48.
Joseph asked Mayes for her
driver’s license and insurance, to
which she gave the officer a pink
Visa credit card. Noticing Mayes
had beer breath and bloodshot eyes, he asked her if she had
been drinking. Mayes said she was driving home from her
sister’s house and refused to answer the question, according to
the affidavit.
Joseph then decided to give Mayes a field sobriety test, but
Mayes barely stepped out of her car independently, constantly
using her car for balance. She also refused to listen to Joseph’s
instructions when he tried to perform an eye test and kept losing
her balance.
When Mayes arrived at the jail, she refused to take a
breathalyzer test, according to the affidavit. She may have made
the wrong choice due to three prior drunken driving convictions,
however. In 2001, she was convicted of actual physical control
while intoxicated and received a one-year deferred sentence.
Also, in 2002, she was convicted of two DUIs, earning a fiveyear deferred sentence. For her latest charge, she faces between
one and five years in prison.
Mayes posted bond the day of her arrest, avoiding spending
her namesake day in jail. She will next appear in court at 9 a.m.
Feb. 28.

All the calculators in a Guthrie Walmart didn’t
help an Oklahoma City man avoid an arrest for
grand larceny Dec. 13.
Early that day, Guthrie police officer Michael
Johns received a call from Walmart for a shoplifting
complaint. The caller said he saw Jeffrey Fallon,
35, pacing in the front of the store with a trash can
and other items in his hands. Fallon went to the
garden center and then went back to the grocery
section, where he loitered around the deli counter
and eventually put the goods in a cart, he said. The
suspect then went to a vending machine, bought a
drink and left the store without paying.
Soon after, the caller and a loss prevention officer
stopped Fallon and asked him to come back inside to complete paperwork about
the theft. Johns reported seeing a trash can full of calculators, which were still
on the secure racking that Fallon reportedly tore from the display area. The
officer also noted that Fallon damaged a cork board in his quest, according to
the affidavit.
Johns then arrested Fallon and took him to the Logan County Jail. While
at the Guthrie Police Department, he saw surveillance video footage showing
Fallon taking the items and hiding them in the trash can, stealing more than
$1,000 worth of merchandise. The loss prevention officer determined Fallon
stole eight Texas Instruments calculators, three USB drives and other items in
addition to the trash can. Fallon faces up to five years in prison for the incident.
Fallon posted a $5,000 bond the day after his arrest. He will appear in court
at 9 a.m. Jan. 24.

Unsolved Cases
The OSBI is renewing the reward offer of up
to $5,000 for information leading to the arrest
and conviction of the two men who shot an
elderly Wagoner man and stole his weapons last
Thanksgiving (11/24/11).
The Wagoner County Sheriff’s Offi ce requested
OSBI assistance with the shooting and attempted
murder of 74-year-old Kenneth Payne last
Thanksgiving morning. About 7:30, Payne was
at the Fort Gibson Wildlife Management Area
Shooting Range sighting in several of his guns
when someone shot him multiple times and left
him for dead. Payne was able to call a family
member on his cell phone for help.
At least four guns were stolen from Payne, was
well as a gun caddy. Payne, who is retired from
the Air Force, lived only a few miles away.
One of the stolen rifl es is a rare Mitchell Black
Lightning .22 magnum rifl e.
OSBI Forensic Artist Harvey Pratt met with
Payne to draw sketches of the two suspects a couple weeks after the
shooting.
Sketch one is that of possibly a Hispanic male in his late 50s with a
light complexion. He stood approximately 5’9” tall and weighed about
160-165 pounds.
The second sketch is that of the second suspect who has dark
curly hair that extends to the back of his shirt collar. He also stands
approximately 5’ 9” tall and weighs about 160 pounds. This man is in
his mid-to-late 30s.

At approximately 6:30 p.m. on Dec.
22, the Langston Police Department
received an emergency call regarding a
shooting that took place in the 400 block
of S. Oklahoma Street. When officers
arrived they found Michael DeWayne
Milton, 50, dead of an apparent gunshot
wound. The Langston Police Department
contacted OSBI for assistance in the
homicide investigation.
Nearly a half dozen OSBI agents arrived on the scene and began processing
the crime scene and conducting interviews of those involved. Still early in
the investigation, it appears the victim was stealing a vehicle from a man’s
front yard. That homeowner tried to stopped Milton from taking the car by
reaching through the car’s window trying to take the key from the ignition.
Milton continued driving the car from the home in a reckless manner with
the car’s owner hanging from a side window. Another man who lived with
the homeowner where the car was being stolen fired several rounds from a
handgun at the car. Milton was struck with an unknown number of bullets
and wrecked the vehicle approximately a block from the original crime
scene. Milton died at the scene. The car’s owner was not injured.
No one was arrested for the homicide. The District Attorney will
determine whether the shooting was justified.

A Prague man was taken to jail Dec. 3 after
he assaulted his little sister and she bloodied
his nose.
Corey Hazelwood, 28, was charged Dec. 6
with assault and battery upon a police officer,
domestic assault and battery, public intox, and
disturbing the peace.
According to the police affidavit, Prague Police Officer Steve Saxton was dispatched to the
Prague Village Apartments on Spitler Drive
in Prague in reference to a fight in progress.
When he arrived, he saw several people standing near the parking lot trying to restrain Hazelwood. Hazelwood was
yelling obscenities and trying to strike the others with a closed fist. He
also observed that Hazelwood was covered in his own blood, which was
coming from his nose.
Saxon spoke to Hazelwood’s mother and she said he was intoxicated, out of control, and had tried to hit his 15-year-old sister. His sister struck Hazelwood in the nose with her fist in self defense. He then
became enraged and tried to hit her again, and they had to physically
restrain him.
The mother continued to try and calm her son down in the parking
lot, but he kept trying to break free from her to assault the officer. Saxton warned him several times to calm down, but he wouldn’t give up.
His mother finally pushed him to the parking lot, sat on top of him and
tried to reason with him. When her attempt failed, she stood up and
walked back inside her apartment.
Hazelwood stood up and started cussing, saying he could kick Saxton’s a**. When he took a step towards Saxton, Saxton spun Hazelwood
around by his shoulders and placed him on the grass face down. After
placing him in handcuffs, he tried to grab Saxton’s crotch, and when he
wasn’t able to, he started kicking at Saxton and struggling with him. He
landed a kick on Saxton’s left leg twice before several Prague firefighters
arrived to help restrain Hazelwood’s legs. He also kicked one of the firefighters while they were trying to provide him with medical attention.
Hazelwood was then transported to the Lincoln County Jail and
booked.

A Meeker man and his girlfriend face a multitude
of felony charges after deputies chased them along
Highway 102 reaching speeds of 120 mph.
Thomas Way, 25, was charged Dec. 28 with
five counts of assault with a dangerous weapon,
leaving the scene of an accident involving injury,
endangering others while eluding police, leaving
the scene of an accident, DUS/DUR, speeding,
failure to pay taxes, and failure to carry insurance
form.
According to the police affidavit, Lincoln County
Deputy Larry Stover was patrolling southbound
Highway 102 Dec. 22 when his radar pinged a
Mustang traveling 68 mph in the 55 mph speed
zone. He activated his lights, and as the car passed
him, he heard the roar of the Mustang’s engine as
it accelerated.
The chase was on.
The deputy finally caught up to the Mustang
at speeds of 120 mph. The tag was covered with
dirt so he couldn’t call the vehicle in to find any
information about it. The chase continued on
for seven miles until reaching the roadblock
on Highway 66. At that time, the driver, later
identified as Way, slammed on his brakes in an
attempt to get Stover to rear end the Mustang. Stover avoided the collision,
steered beside the car and tried to block it from moving forward. Way then
attempted to ram the patrol car and escaped, turning south on 102.
The chase was on again, but this time, Way deliberately tried to ram cars
along the highway and almost hit a car exiting a driveway. Finally, he turned
onto CR 980, drove through the “T” at the intersection at 3330 Rd., and
crashed into a post. Way and his passenger, Charlene Walker, 29, took off
running. Walker was quickly caught and told deputies she had just met
“Troy” on the internet.
Officers set up a perimeter, but they could not locate Way.
During a search of the Mustang, Walker finally confessed Way was her
boyfriend and they lived in Meeker. She was then carted off to jail and later
charged with harboring a fugitive and obstructing an officer.
On Christmas Eve, deputies went to Walker and Way’s home on Highway
18 and arrested Way. He tried to escape again, but with no luck this time. He
was taken to the Lincoln County Jail and booked.
