Presumed Innocent Until Proven Guilty PAYNE COUNTY 5 | MAY 2021
A Glencoe man allegedly set fire to his own truck,
which in turn damaged a Yale service station on
March 31.
According to reports, the incident happened at the
Maverick Mini Mart, located in the 100 block of E.
Chicago at approximately 11:22 a.m.
The suspect, Russell Dean Mitchell Jr., pulled into
the service station and parked next to a gas pump.
He then stayed on his phone for about 11 minutes
before getting out of his truck and paying for $16.23
worth of gas with his credit card.
Around 11:25 a.m., surveillance video showed Mitchell throw a burning
object at his truck. On the first throw, Mitchell threw the object at his front
window. It bounced off and landed on the ground. The second and third
throws also hit the truck before falling to the ground.
On the fourth throw, the burning object went inside the open driver’s
back door window, causing an explosion and flames. The awning, gas
pump and lighter sign at the service station were all damaged in the fire.
Mitchell is being charged with arson in the third degree. His bond was
set at $10,000, and he is scheduled to appear in court on May 19, 2021.

TWO SAPULPA MEN PLEAD GUILTY TO
CHILD EXPLOITATION CRIMES
Two Sapulpa men pleaded guilty on April 8 in
U.S. District Court to child exploitation crimes,
announced Acting U.S. Attorney Clint Johnson.
Aaron James Seney, 32, pleaded guilty to
distribution and receipt of child pornography and to possession of child pornography.
Nicholas Robert Hale, 36, pleaded guilty to attempted coercion and enticement of a minor.
Both men pleaded guilty before U.S. District
Judge Gregory K. Frizzell.
“Crimes involving the sexual exploitation of
children are one of law enforcement’s highest
priorities. Every day we strive to protect the most vulnerable members of
our community from falling victim to child predators, like Seney and Hale,”
said Acting U.S. Attorney Clint Johnson. “My office and our law enforcement partners will continue to identify, locate, and prosecute child predators and anyone who seeks out or produces child pornography.”
In a written plea agreement, Seney admitted that between March 24,
2020, and September 2, 2020, he distributed and received child pornography via the internet. He further admitted that he knowingly possessed
and accessed child pornography, which involved at least one prepubescent minor and a minor that had not attained 12 years of age. U.S. Immigration and Customs Enforcement’s Homeland Security Investigations,
the Tulsa Police Department, Sand Springs Police Department and Oklahoma State Bureau of Investigation conducted the investigation. Assistant
U.S. Attorney Christopher J. Nassar is prosecuting the case.
In a written plea agreement, Hale admitted that from Nov. 9, 2020, to
Dec. 22, 2020, he used a social media app to persuade and entice an individual he believed was a minor to engage in sexual activity. Hale believed
he was interacting with a 14-year-old male but instead was communicating with an undercover officer from the Rogers County Sheriff’s Office.
The two eventually agreed to meet at a convenience store in Verdigris in
order to have sex. When Hale arrived, he was arrested and found to be in
possession of methamphetamine, a loaded pistol in the front driver’s side
door and an AR-15 rifle in the trunk of the car. The Rogers County Sheriff’s
Office conducted the investigation. Assistant U.S. Attorneys Sandra M.
Urban and Christopher J. Nassar are prosecuting the case. Hale will be
sentenced on July 9, 2021.

A Meeker man is being charged with assault and battery after he allegedly assaulted
a police officer after being arrested on April 9.
According to the affidavit, the officer was
dispatched to a residence in the 400 block of
Loy Street in Meeker at approximately 12:52
p.m. to investigate a domestic in progress.
When he arrived, he met with a man who told
him 28-year-old Jerry David Bell assaulted
both him and a woman at the residence.
The woman, who had visible red marks and
scratches on her neck and upper chest, told
the officer Bell had shoved her across the living room the day before. She added that she
was moving out of the residence with her two
children, who witnessed the altercation.
The officer placed Bell under arrest.
Bell became belligerent, and when the officer explained why he was being
arrested, the man replied, “I don’t care. I will see you in court.”
The officer took the man to the Lincoln County Jail.
On the way into the jail, Bell started resisting and kicked the officer in the
right leg. He and Bell fell to the ground, and the officer injured his elbow. Another officer assisted with taking the man inside.
Bell is being charged with battery/assault and battery on a police officer.
His bond was set at $3,000, and he is scheduled to appear in court on May
6, 2021.

Guthrie man William Everett Holmes, 44, was put in jail
on April 13 after a deputy found drugs and paraphernalia
in the stolen vehicle he was driving.
According to the police report, a Logan County deputy
was on patrol around 4 a.m. when he saw a green truck
headed westbound on State Highway 33 approaching
the stop sign at State Highway 74. The tag lights on the
truck weren’t working, and the registration sticker said
2019.
The officer stopped the truck and made contact with
the driver, identified as Holmes.
Dispatch advised the officer that the tag was expired
and belonged to a 1998 Mazda. The truck had also been
reported stolen out of Norman.
The officer conducted an inventory of the truck, and he found the following in a
handbag that was under the driver’s seat: two needles loaded with a clear liquid
and a reddish-orange liquid, a spoon with cotton and white crystals stuck to it,
and some empty needles. The cotton on the spoon field-tested positive for meth.
Holmes is being charged with possession of a stolen vehicle, unlawful possession of a controlled dangerous substance, and unlawful possession of drug paraphernalia. His bond was set at $5,000, and he is scheduled to appear in court on
June 24, 2021.

A South Carolina man was caught rubbing buttered toast all over his
neighbor’s SUV window. Seems like a foolproof plan, how did he get
caught? According to MSN, He just dropped the toast a few feet away
from the car and made his departure, causing a nearby woman to notice and call the police. The police charged the now hungry man with
“malicious damage to property” and estimated the cost of damage to
be about $1.
What’s the hottest you’ve ever been? Temperature-wise of course, because if it was in physical terms, we all know we were the hottest at our
5th grade, bowl-cut, chubs stage. But really, to what extent would you
go to cool off ?
Hopefully not so far you’d get arrested, but this is exactly what a group
of four young men in Germany did. On a hot day, they decided to make
their own pool in a car. In a BMW no less. A policeman noticed a very
strange convertible driving down the road. Upon closer viewing, it appeared that the bathing-suit clad men were splashing around in the water-fi lled car, clearly intoxicated. Though there was no law against driving
around with a pool in someone’s car, they were probably charged for
driving without a permit. Talk about hot water.
What do you guys think about sausage? I suppose it’s better than a
hot dog, which in turn is better than bologna (which is basically giant hot
dog slices?). And no matter what, it has to be better than Lunchables
*shudder*.
No matter your opinion, sausage was a huge disappointment for this
Phoenix man. He attempted to rob two large businesses, fi rst an Ace
Hardware and then a Safeway. He put his hand under his shirt to look
like a gun, but the cashier was not fooled and calmly said “no” to his request for money. Equally unsuccessful was his attempt to rob a Safeway,
which resulted in him being escorted out of the building. He waited a few
minutes before returning into the store to snag a small breakfast sausage
and was therefore charged with shoplifting. I guess all that failing worked
up an appetite.
Sometimes people don’t want their babies. Throughout history, these
people have found convenient ways to get rid of them. In the middle
ages, a popular solution was to leave a swaddled infant on the doorstep
of a misfortunate new parent. Worse for the child, another option was an
orphanage. In later times, parents could even put their kid in the circus
for life. The last one, I’m actually jealous of.
It might not have been this Florida woman’s goal to give away her child,
but that’s sure what it looked like. She had gone shopping at Dillard’s,
and tried to shoplift $260 worth of clothing using her baby stroller. When
a police offi cer followed her out to her car, she fl ipped out and eventually threw her baby in its little carseat at him. The baby was not injured.
The shoplifter received three charges, including “resisting a police offi cer
without violence”. Um. What would be violent, throwing her entire family?

BURNING DOWN THE HOUSE
Two Blackwell men were placed under arrest
after they allegedly worked together to burn a
home down for insurance money.
According to reports, the Blackwell fire marshal contacted police officers regarding an arson case on March 4. A woman allegedly told
the fire marshal and she and 37-year-old Trulin Eugene Williams had gone to the 800 block
of McKinley to burn down a house. She said
Rocky Lee Auterson II, 32, offered to give Williams a new truck and some money if he burned
down the house.
The woman explained that Williams broke into
the home through the backdoor and used a propane bottle and torch to set fire to the home.
While investigating the incident, the fire marshal learned that Auterson bought the home on
February 12, 2021, and bought insurance for
the home on February 18. The house fire was
reported on February 21, and Auterson filed an
insurance claim just three days later.
Officers spoke to Auterson, who said he
bought five rental homes. Williams was helping
him work on them. When an officer asked the
man about the fire, Auterson asked for his attorney.
On March 9, officers were advised that a man needed to be transported
from the Ponca City hospital to a health center in Stillwater. The man was
Auterson, and he told a Ponca City officer he wanted to talk about the
house fire.
The investigating officer went to speak to the man, but Auterson changed
his mind and again asked for his lawyer.
On March 10, the officer received body cam footage from the Ponca City
officer. The footage showed Auterson tell the officer that “it was arson” and
that he had taken a bottle from Williams and put it underneath the garage
near a workbench. He also said that Williams and a woman were trying to
extort him. The man also allegedly admitted that he wanted to do it so he
could collect the insurance.
Auterson is being charged with conspiracy, arson in the second degree
and false claim for insurance. He was granted an OR bond and is scheduled to appear in court on May 7, 2021.

OKLAHOMA FILES MORE THAN 20 INDIAN COUNTRY MURDER CASES
40 Violent Crime Cases Include 22 Murder, Four Manslaughter, and Six Sexual Abuse Involving Minors Cases
The United States Attorney’s Office for the Eastern
District of Oklahoma announced at the end of March
it has filed forty violent crime in Indian Country cases
since the March 11, 2021, Oklahoma Court of Criminal
Appeals opinions in Bosse v. Oklahoma and Hogner
v. Oklahoma. The cases include twenty-two murders,
four manslaughters, and six sexual abuse offenses involving minor victims.
“Our goal has been and will continue to be protecting the people of the Eastern District of Oklahoma by
focusing all of our available resources on ensuring that
violent offenders are transitioned from state custody to federal custody to be tried
for the violent crimes they have been charged with committing,” said Acting United
States Attorney Christopher J. Wilson. “Our staff has been working many long
and stress-filled hours reviewing law enforcement reports and preparing charging
documents. The logistics of handling this volume of cases has been challenging
and has required the cooperation of District Attorney Offices, Sheriff Offices, the
Federal Bureau of Investigation, the United States Marshals Service, and the Oklahoma Department of Corrections.”
Many of the recent federal charges filed by the Eastern District of Oklahoma involve defendants previously convicted in state court. The Supreme Court decision
in McGirt v. Oklahoma and the recent Oklahoma Court of Criminal Appeals rulings
in Bosse and Hogner held that Congress never disestablished the reservations of
the Muscogee (Creek) Nation, Chickasaw Nation and the Cherokee Nation, and
the State of Oklahoma lacked jurisdiction to prosecute major crimes involving Native Americans occurring on these reservation lands. Based on these rulings, many
state convictions have and will be vacated. It will be the responsibility of the federal
government and/or tribal governments to prosecute the offenders. It is anticipated
additional decisions impacting the Choctaw and Seminole Nations will be issued
by the Oklahoma Court of Criminal Appeals in the coming days.
“As I stated when the recent Hogner and Bosse opinions came down, the Eastern District U.S. Attorney’s Office has been identifying cases of violent offenders
currently in custody within the areas of the Cherokee and Chickasaw reservations
which could be impacted by a change in Indian Country jurisdiction. The collective
efforts of our state, local, tribal, and federal partners have enabled our office to
have federal charges in place to avoid these violent offenders from being released
from custody. The forty cases filed to date are only the beginning. We are reviewing and making charging decisions on additional cases daily. In addition, we have
already discovered approximately 150 violent offender cases in the Choctaw and
Seminole areas over which we anticipate assuming federal criminal jurisdiction if
the OCCA renders similar rulings,” said Wilson.
“I am keenly aware of the hardship the jurisdictional change has placed on so
many victims,” said Wilson. “As the previous state convictions are being vacated
for lack of jurisdiction, victims and victim families are being forced to relive the entire process. We are committed to assisting the victims of these violent crimes as
their cases navigate through the federal criminal justice system.”
A criminal complaint does not constitute evidence of guilt. A criminal complaint
is only a method of bringing formal charges against a defendant. A defendant is
presumed innocent of the charges and may not be found guilty unless evidence
establishes guilt beyond a reasonable doubt.

BARTLESVILLE MAN PLEADS GUILTY FOR DOWNLOADING
AND VIEWING MORE THAN 1200 IMAGES OF
CHILD PORNOGRAPHY
A 76-year-old Bartlesville man who downloaded and viewed more than 1200 images
and 79 videos of child pornography on his
electronic devices pleaded guilty on April 1 in
U.S. District Court.
Acting U.S. Attorney Clint Johnson announced that Richard Lee Ryan Jr. pleaded
guilty to possession of child pornography.
U.S. District Judge John F. Heil III ordered the
defendant to self-surrender to the U.S. Marshals Service on April 5, and set sentencing
for June 30, 2021.
“Child pornography is not a victimless
crime. For nearly a year, Richard Ryan Jr. hid
behind a screen and downloaded images of
children being exploited and raped. With every download and view, he revictimized those children again and again,” said Acting U.S. Attorney Clint
Johnson. “Thanks to our partners at the FBI and Homeland Security Investigations, Mr. Ryan will be held accountable for his actions.”
Ryan Jr. admitted that from June 26, 2019, to June 6, 2020, he knowingly
possessed and viewed child pornography, which involved at least one prepubescent minor and a minor that had not attained 12 years of age engaging in
sexually explicit conduct.
Investigators initially discovered Ryan Jr. when he uploaded an image of
child pornography to a chat on an online messaging app. On June 6, 2020, a
federal search warrant was executed at the defendant’s home and numerous
electronic devices were seized, five of which contained child pornography. Investigators discovered 79 videos and more than 1200 images depicting child
rape and bestiality on the devices.
The FBI and U.S. Immigration and Customs Enforcement’s Homeland Security Investigations conducted the investigation. Assistant U.S. Attorneys
Benjamin D. Hargrove and Christopher J. Nassar are prosecuting the case.

Cpl. Kyle Davis, a deputy with the Washington County Sheriff ’s
Department, became involved in an altercation on March
25 with a violent inmate that was arrested on a warrant.
He was killed by the suspect in the line of duty.
An investigation into the incident is being conducted by
the Oklahoma State Bureau of Investigation, the District
Attorney’s Offi ce, the Washington County Sheriff ’s Offi ce,
and the Bartlesville Police Department.
The suspect was arrested as a result of an ongoing
investigation by the Bartlesville Police Department
and Oklahoma Bureau of Narcotics and Dangerous
Drugs. Seventeen individuals were arrested on
March 25 between 6 a.m. and 9 a.m.
The suspect was uncooperative and aggressive toward detention staff at the
Washington County Detention Center.
During a physical altercation between the suspect and staff members, a deputy
sheriff was injured and transported to the hospital, where he succumbed to his
injuries.
The OSBI, BPD and the 11th Judicial District Attorney’s Offi ce are working
together to investigate the deputy’s death.
As of press time, the name of the suspect involved in the death of the deputy
has not been released and no charges have been fi led.
