A Duncan man was taken into custody after he allegedly sexually abused a 12-year-old
child in September.
Dennis Richard Tomlinson, 40, was
charged Oct. 5 with felony Lewd or Indecent
Acts To Child under 16 years in Stephens
County District Court.
According to a report, Duncan police were
contacted by OKDHS Child Protective Services about a report of possible sexual abuse
on Sept. 26. The child reported to a counselor
that Tomlinson had sexually abused her possibly on or between Sept. 10 and Sept. 24. The child was interviewed
at the Mary Abbott Children’s House in Norman Oct. 1 and gave details of the alleged sexual abuse that had happened more than once.
Tomlinson initially denied the accusations, but in a second interview, he allegedly admitted to touching the child over her clothing on
three different occasions on the same day.
Bond was set at $100,000 and Tomlinson faces a possible sentence
of no less than three years nor more than 20 years by imprisonment
if convicted of the crime.
His preliminary hearing is set for Dec. 12.

An Oklahoma City man was taken into custody
after authorities tracked him down less than two
hours after he robbed the IBC Bank in Duncan.
George Netherton, 40, was charged Sept. 21
with felony first-degree robbery in Stephens County District Court.
According to the report, Officers responded to a
bank alarm at the IBC Bank on W. Main. An employee described the robber, Netherton, as a white
male with glasses wearing an OU cap and red tshirt. He had presented the teller with a note demanding money. The teller began giving Netherton 100’s and 20’s as he told her, but then he told
her it was enough and left the bank on foot.
Investigators soon discovered Netherton had hailed a taxi to Oklahoma
City and they tracked him down to a Burger King near 74th and May Ave.
When authorities asked about the money he had in his possession, he told
them it was the bank’s. He was arrested without incident.
That evening at the Stephens County Jail, he was interviewed and said he
had just been released from the Stephens County Jail at about 2:00 p.m. and
realized he had no money, no family, and no where to go. He decided to rob
the bank in order to go to federal prison. He told how he had a written note
asking for loose bills in 100’s and 20’s.

A Duncan man was taken to jail
in Grady County after he allegedly
pointed a gun at a woman along I-44
in a classic case of road rage.
Heath Eberhart, 32, was charged
Oct. 11 with feloniously pointing a
firearm in Grady County District
Court.
According to the report, the victim
called OHP after two males in a white
car changed lanes in front of her. The
driver then rolled down his window
and pointed a gun out the window at
her.
OHP tracked the car down at SW 89th and I-44 and a Ruger
9mm handgun and a Taurus 9mm handgun in Eberhart’s car.
Eberhart and his passenger, Kenneth Jenkins, were taken
into custody and transported to the Grady County Jail.
Bond for Eberhart was set at $30,000 and was ordered to
return to court for his preliminary hearing on Nov. 7 with
counsel.

A Drumright man was taken into custody after he robbed an
adult store in Stillwater and took off with two magazine, $150,
and a new rubber girlfriend.
Jesse Allen Smith, 27, was charged Oct. 15 with robbery with
a dangerous weapon and attempting elude police in Payne
County District Court.
According to information in the case, Smith went into the
Christy’s Toy Box on N. Perkins Rd. late Oct. 11 and threatened
the clerk with a knife. He then took the blow-up doll, the
magazines and the cash and fled.
Authorities caught up with Smith in his 1999 Ford truck at
the corner of 3rd and Perkins Rd. Smith refused to pull over
and a high-speed chase ensued. At the intersection of Jardot
and Sixth, he blew through the signal light and narrowly missed a patrol car. The chase
ended when Smith crashed his truck into a telephone pole at the end of a dead-end
street and had to be tased into submission.

A former high school coach accused of having sex with a
female student fights to have his case dismissed.
The suspect’s attorney said the state’s age of consent law
is unconstitutional.
The controversial legal fight centers on a state law
banning sexual relationships between students and
school employees.
The former educator accused of breaking that law,
Tyrone Nash, allegedly carried on a sexual relationship
with a female student at Western Heights high school.
Nash asked the court to overturn state law.
Under the current law, it would legal for the judge in the case to have consensual
sex with a 16-year-old girl, but Nash, as a former school employee, may not
have the same right.
That’s why the defense said the law should be unconstitutional.

Grady County sheriff’s deputies
arrested an 84-year-old man for providing
alcohol to minors after completing a sting
operation Aug. 24.
Lt. Ricky Rushing reported receiving
a phone call from another sheriff, who
had an 18-year-old in his custody. The
teenager said he could buy alcohol from a
man in Chickasha known as “Bootlegger
Willie.”
“Every kid in town knows they can go
to Bootlegger Willie’s house in town to
buy alcohol from him,” he said. “All you
have to do is knock on Bootlegger Willie’s door and he will answer.”
The teen, not wanting an arrest for underage liquor use, agreed
to serve as the sheriffs’ confidential informant after they confronted
him at the Grady County Fairgrounds. The officers gave him $20
and he showed them the way to Bootlegger Willie’s place, also
known as Lawrence Hayden’s residence, at the 1700 block of Grand
Avenue. The informant went inside the home and came out with a
Sunny Brook Kentucky Blended 80 proof whiskey.
The officers took the whiskey as well as $5 change, then
immediately went inside the residence to confront Hayden and ask
him why he was providing alcohol to minors. Hayden said he bought
the alcohol for the teen that morning and was “just holding it” for
him until he returned. They took the $15 from his wallet but did not
take him into custody due to his age and health issues, according to
the affidavit.
Hayden was charged Oct. 3 with furnishing alcohol to minors,
a felony. He was arrested Oct. 9 and released on a personal
recognizance bond. After his arrest, reporters went to his home for
an interview. His response, “I don’t want you taking my picture.
‘Have you been selling alcohol to minors?’ NO!”
“Bootlegger Willie” has a court date set for 2:30 p.m. Feb. 21.

A Tuttle man faces felony
charges after police say he was
selling prescription drugs to
repair his car.
On Oct. 4, Tuttle police
officer Steven Wylie pulled
over a Hyundai driven by
Brayden Cole Traxler, 18, for
failing to signal a left turn.
When Wylie confronted
Traxler, he reported smelling
marijuana coming from inside
the vehicle.
Traxler said he was driving
home from the local skate
park, but he had droopy eyelids
and was talking too slowly, so Wylie had him get out of the car.
Traxler stumbled into the driver’s door, didn’t know what time it
was and then failed a field sobriety test, according to the affidavit.
Wylie then discovered Traxler was intoxicated due to taking
several Lortab pills before driving. He was arrested and his car
searched, which revealed a bullet shaped pipe with marijuana
inside, 12 Xanax pills and a black wood container with marijuana
inside.
When Wylie asked Traxler about the pills, he said selling
them was a “back-up plan” to get money for items to repair his
car. Traxler also said the wood container was a one-hitter and
admitted owning it.
Traxler faces charges of possession of a controlled substance
with intent to distribute, driving under the influence of drugs
and possession of marijuana. He posted a $10,000 bond the
next day.
Traxler will appear in court at 1:30 p.m. Nov. 7.

One of the things that is becoming
more prevalent, and with the
passing of the new open carry law,
will only continue to rise, is the number of people walking and driving
around armed. For law enforcement, this obviously creates some
challenges in our dealings with the public. I am going to attempt to
explain what we would like from the citizens who choose to go armed,
and what they can expect from us.
First, all people who wish to carry a gun on their person are
required to attend an approved concealed carry class. This goes for
those who wish to carry concealed or open. Upon completion of the
course and the requirements needed, you will be issued a Concealed
Carry License, or CCL. Let me point out, that having a CCL is a
privilege, not a right. It is issued by the state, and with it come some
responsibilities.
One of those responsibilities, and the one that is most important
to us law enforcement professionals, is the obligation to notify us
IMMEDIATELY upon contact. Lets say you get stopped for speeding
and you are a CCL holder and are armed, whether it is on your person
or just in your vehicle. The Trooper gets out of their car and asks
you to step back to them with your driver’s license and proof of
insurance. You should, before anything else, declare that you have
a CCL and are armed. Don’t wait until we see the CCL in your wallet
to tell us....that’s too late! They will then instruct you on what they
would like you to do to address this situation. There are several
things we may do at this point to accomplish this.
We may ask you to say (not reach for or move towards) where
the weapon is. Simply say the location, keeping your hands on the
steering wheel or where they can be seen. If its on your person, we
may wish to disarm you for the duration of the traffic stop, and will
give instructions accordingly. We may simply separate the weapon
from the ammunition and make the weapon safe, and then leave it
in your vehicle. Each officer will handle this in the way that he or
she chooses in order to maintain their own safety. None of these
methods are meant to infer that we feel threatened by a CCL holder,
or that we think you are a criminal or bad person. They are simply
ways that we can deal with the issue of a gun being present in order
to maintain our safety and the safety of others.
Hopefully, this will give you some guidelines on what we are
expecting when you come in contact with us while carrying a
firearm. With respect and understanding, we can all feel safe with an
armed citizen, while respecting that citizen’s right to carry. Thanks

Children have a wonderful
capacity for trust. The faith
they put in adults is unqualified, and that should humble us; we
often don’t deserve it.
Sometimes kids suffer from intentional betrayal by a trusted
adult, like former Penn State football coach Jerry Sandusky, recently
convicted of sexually abusing underprivileged young boys. Other
times, they are neglected by society at large, as are the 1.7 million
children with a parent behind bars. Many of these kids face enormous
obstacles, but get little notice.
The Bible affirms that children are a central focus of God.
Our national problem is not that we somehow undervalue children;
it’s that we don’t always know where to look to find the children most
in need of our help. Inmates’ children in particular get placed on
the back burner. They grow up in single-parent homes, or they get
shuffled into foster care. They are five times more likely than their
peers to live in poverty. They often endure confusion, loneliness,
depression, abandonment, social ostracism, and profound anger.
Should we be surprised if they often follow their parents to prison?
It doesn’t take much to ease the burden of an inmate’s family.
Churches—and other people of good will—can incorporate prisoners’
children into their existing programs, like VBS, youth mentoring
programs, or summer camps. They can make sure kids have the
supplies they need to succeed in school, or gifts to celebrate the
holidays; the opportunities are boundless.
If we take seriously the notion that every child has inherent worth
and deserves our society’s nurture and protection, we cannot afford
to ignore children with an incarcerated parent. Like Jesus, we must
reach out to them, and their trust will for once not be betrayed. In
turn we will discover that the blessing goes both ways: They will
teach us what it means to have faith that pleases God, faith that
presses in close, believing everything will be okay.

A Chickasha man and ex-con faces second-degree burglary charges after trying
to steal aluminum from a local home Oct.

Chickasha police officer David HarperHead was dispatched to the 900 block of
South 9th Street for a burglary in progress
at about 3:20 that day. The homeowner
came to the house and realized there was
an intruder, and dispatch said a child
made the police call.
Harper-Head arrived at the home to see
Jessie Avery, 45, run from the front of the
house and hop a fence into the backyard of the next door neighbor’s
home. Witnesses said Avery was trying to hide in trees and brush,
but ran east after Harper-Head saw him.
Two other police officers eventually apprehended Avery and took
him to the ground. He was arrested for resisting an officer, and a
search of his pockets turned up a used syringe. Harper-Head said
he knows Avery to be a habitual methamphetamine user, through
Avery’s experiences with the court system.
Avery said he believed the house was abandoned, so he felt it was
OK to take items from it, according to the affidavit.
The homeowner said he was remodeling the home and staying
at another residence. When he confronted Avery, the suspect said
he had permission from the homeowner to remove his belongings.
When the owner challenged that story, Avery reportedly apologized
and went outside, where the homeowner chased him. Avery then
said the owner “better move his truck or he would do something
real bad”, as Avery did not want to go back to prison. Afterward, the
man said Avery assaulted him, kicked his child and ran when police
arrived.
Police determined Avery tried to steal an aluminum door and other aluminum items form the house.
Avery remains in custody on a $25,000 bond. He will appear in
court at 1:30 p.m. Nov. 7.

At approximately 10:00 pm on
June 6, 1998, 16-year-old Dena
Dean left the Marvin’s Food
Store located in the Town West
shopping center in Tulsa. Dean
was never heard from again.
Dean’s vehicle was discovered
in the parking lot of the Marvin’s
Food Store. Almost a week later,
her body was found in a wooded
area a few miles away near
Berryhill.
No has been arrested in the case.

inmate sentenced to die for
killing three women in 2007 was
found dead by his cellmate Sept.
3.
No foul play is suspected in the
death of William Eugene Davis,
55. He was found unresponsive
about 6:35 a.m.
Davis was convicted on three
counts of fi rst-degree murder in the Sept. 4, 2007,
shooting deaths of his sisters, Tami Link, 52, and
Sheila Ellis, 54, and Link’s mother-in-law, Letannah
Bishop, 87.
Davis was subdued at the scene by his legally blind
brother-in-law, Brent Link, who disarmed and
severely beat Davis after the shootings.
Davis was found guilty by a jury in Cleveland County
in February 2010. The jury recommended a death
sentence, and Davis was sentenced to death by lethal
injection by District Judge Lori Walkley the following
month.

Deadly Hiccups
Patrick Myers, a 27-year-old South Carolina man was
jailed after he allegedly shot a friend in the face while
trying to cure him of the hiccups.
According to police, Myers and two friends were
watching a football game and drinking at his residence
when one of the men developed a case of the hiccups.
That’s when Myers allegedly grabbed a gun and
pointed it at his friend in an attempt to scare the
“hiccups” out of him.
Investigators say hiccups were the least of his friend’s
worries when the gun that was pointed at his face
suddenly went off. The 22-year-old victim died at the
scene.
Myers told detectives that the shooting was an
accident and that he thought the gun had been loaded
with “dummy rounds.”
Myers was booked into the Bell County Jail and charged with manslaughter.
